https://lnkd.in/etTaij3K For those of you who deal with the testimony of treating physicians and whether such witnesses can be subject to financial-bias discovery, the recent Tillman v. Sweat case out of the 5th DCA provides an excellent overview of when treating physicians morph into expert witnesses. When this occurs, the witness is considered a "hybrid" witness and subject to financial-bias discovery. A party merely declaring that the physician is a "treating physician" is not enough. Instead, the court looks to the witness's intended testimony as set forth in pretrial disclosures to make the ultimate determination. #jeffisappealing #jeffsappealing #personalinjury #insurancedefense
