On this #IndigenousPeoplesDay, I'd like to share a small story about just how essential it is to invite Native American evaluation and criticism when drafting policy and crafting legislation. In the early stages of co-sponsoring #SB907 / the Local Equitable Access to Food (LEAF) program with NextGen Policy, we submitted the bill text to the California Food and Farming Network (CFFN) for consideration. The bill called for the creation of a non-competitive grant program throughout California to fund high-quality CalFresh/EBT access at every certified farmers' market. One of the most helpful pieces of feedback we received came from Taylor Thompson on the CFFN committee, asking whether Tribes could operate certified farmers' markets and benefit from the program. Until I received this question, I had assumed that Tribal governments could operate certified farmers' markets, as they can be run by farmers, non-profits, or local governmental bodies. Having this prompt forced me to look further and submit a question to the California Department of Food and Agriculture (CDFA), who had to run it by their legal department for interpretation. The answer surprised me: Tribal governments could NOT run certified farmers' markets because CDFA did not have jurisdiction to certify markers on tribal land. Because we received this answer early in the process, we were able to amend the bill to make an exception only for farmers' markets operated on tribal land. If we had not received this feedback at all, or if we had received it late into the legislative process, the bill likely would have accidentally excluded communities who we absolutely wanted to include. It became a more inclusive, equitable, and altogether better piece of legislation because of this feedback.
