I was so lucky to have our pal and client John Maltbie of Louis Vuitton as my special guest on day 4 of #Chat_ENT at the University of Miami School of Law! We focused on the early impact of #generativeai on the #fashion industry. What did we talk about? * The early spectrum of AI-related copyright cases formed by #thaler, #kashtanova, and #allen. * The use of #generativeai tools on product design, and how brands need to implement a reliable clearance process, no matter the means of design. * How #AI is working to identify counterfeits, and how counterfeiters are using the technology to make fakes. * The perils of licensing content created by tools like #Midjourney, and the importance of obtaining registrations for copyrighted content. Following on my previous post, it seems that the creative power of A.I. is not without its legal pitfalls. Recently, The Times asked A.I. to create the Joker, only to find that it generated a copyrighted image. This raises some interesting questions around the use of A.I. and intellectual property rights. One can imagine a company as large as Warner Bros will be able to defend their copyrights if need be, but what about the individual? Protecting IP is incredibly costly. If ethically developed, I can imagine a future where AI helps individuals defend their IP as well. A future where images generated by AI will show their source of inspiration and can even help artists dissect their work for influences that may deserve credit. Very excited to have shared my thoughts on how generative AI is overstretching legal and regulatory frameworks in the US and beyond in the WIPR - World IP Review. Sunny Kumar, UK Head of IP at Ashurst, and I contribute our thoughts on the U.S. Copyright Office undertaking a study of the copyright law and policy issues raised by AI systems.
