American broadcasters have been using a very antiquated loophole to avoid paying performers a royalty for the songs that they choose to fill their airwaves with.
This has been going on for 100 years.
American broadcasters characterize their exemption to paying royalties as a "mutually beneficial promotional tool" for performers and broadcasters.
They argue that paying artists a royalty for broadcasting their work is “unwarranted,” “unnecessary,” and could be "fatal to radio stations and disrupt radio business models in the long term."
So while literally any entity that broadcasts music over the internet is required to pay digital performance royalties for the sound recordings they play,
in the USA artists are still not paid a royalty when their songs are broadcast on AM/FM radio.
American Broadcasters continue to profit from artists intellectual property.
"It's a very important fight to make sure that radio helps share in its wealth and pay the creators that form the foundation of its business model." - Michael Huppe, SoundExchange President and CEO.
Today is #WorldIPDay and we're calling for an end to one of the largest inequities in the music industry. AM/FM radio continues to profit from the intellectual property of performers without compensating them for their work. It's time that performers receive their fair share for their music that serves as the foundation for a multi-million dollar business.
