With the passing of the Digital Personal Data Protection Act last week, India finally has its data privacy law in place. It is a matter of time now before it comes into force. While we agree with the general approach to have a simpler law for India, the Act does have some significant interpretational challenges apart from being stricter than global standards in some ways. Recently, the Indian Parliament passed the Digital Personal #DataProtection Act, completing a 5-year journey to introduce comprehensive #dataprivacy legislation for India. It's now undeniable that this Act will shape the #data privacy landscape in India. While it draws inspiration from the previous version, it's notably simpler and deviates significantly from the #GDPR model of privacy laws prevalent today. Still, it incorporates substantial changes, addressing many concerns from the previous draft. As the Modi 3.0 starts major reforms and legislation work starts proceeding by working on important laws and acts . one of them is Digital personal Data protection act 2023 , the law is yet to be implemented. At least 25 rules are required to be finalized to set the counter of the overall privacy framework.

The DPDP Act, passed in August 2023, is India's first comprehensive law on digital personal privacy. It sets essential rules for the collection, processing, and storage of personal data, impacting various sectors of the economy. Public consultation will begin before the upcoming Parliament session in July, giving stakeholders up to 45 days to provide their input. The Digital Personal Data Protection Act,2023. India enacted its new privacy law—the Digital Personal Data Protection Act, 2023 (DPDP Act) on August11,2023. The law will come into effect on a date to be decided by the central government, which is authorized to determine different dates. APPLICABILITY: The DPDP Act applies to all data, whether originally online or offline and later digitized, in India for the purpose of provision of goods and services. NOT APPLICABLE Any Data processed by an individual for any personal or domestic purpose or any personal data which is publicly available. KEY TERMS: u DATA PRINCIPAL: Any person to whom the personal data relates. If the person is child, it includes its parents or lawful guardian and person with disability, includes her lawful guardian, acting on her behalf. u DATA FIDUCIARY: Any person who is alone or in conjunction with other persons determines the purpose and means of processing of personal data. u CONSENT MANAGER: A person registered with the Board who represents on behalf of Data principal and takes the action on behalf of data principal at the time of granting, managing, reviewing and revoking consent. #dataprotection #digitaldata #indianlaw

Mediation under Data Protection Dispute! The Data Protection Board of India has the discretion to inquire about any complaint further or even close such complaint.
