🍏A tribunal has ruled that tech giant Apple unfairly dismissed an employee who took 2 photos of a female colleague. 📱The employee sent the photos to a group chat with 3 other colleagues, one of whom reported him to a manager. ❌An internal investigation found him guilty to sexual harassment and he was later dismissed. The judge ruled that this was not a reasonable response from Apple. 📸The employee had taken a photo of the food counter in the employee canteen, behind the counter a female employee was visible. 📲He sent it to the group chat with a message that said “Mate, you’re welcome” alluding to the fact that one of the other members of the group had a crush on the pictured female. His colleague responded to the photos with “Look at bae there . . . so cute working her ass off but still looking great” and “that’s my girl”. On a separate occasion the claimant took a photo of the same girl and sent it directly to his male colleague. Both men were taken to disciplinary and dismissed. The photographer said that his dismissal was unfair as the investigation conflated him taking photos with the comments his colleague had made. 👩⚖️The judge stated that Apple’s harassment policy was vague and did not contain a clear definition of harassment. 🍏He also found that the female employee was unlikely to have known that the photo was taken and therefore his behaviour could not have impacted her. ➡️A harassment policy should refer to the legal sense of harassment including how an employer could determine whether conduct was unwanted or had the effect of violating a persons dignity or creating an intimidating environment for them. 🍎The judge ruled Apple had not responded reasonably as there was no evidence that anyone took offence to the photos and therefore the dismissal was unfair. ‼️This case shows just how important it is for employers to have clear and specific policies on sexual harassment. It is essential to distinguish between harassment, bullying, banter and discrimination. It is also important that those conducting investigations and disciplinary hearings have been trained and understand sexual harassment thoroughly.

Analysis of Apple Gender Pay Disparity Lawsuit ⚖️🍏 Two female employees have filed a class-action lawsuit against Apple (NASDAQ: AAPL) alleging gender-based pay disparities. This lawsuit, filed in a San Francisco state court, represents 12,000 women and challenges Apple's compensation and performance review practices. Key Points: 🏢 Compensation Practices: The lawsuit highlights Apple's past practice of considering prior salaries for new hires, which changed in 2018 due to California law. Plaintiffs argue this still leads to pay disparities. 📊 Performance Reviews: Allegations suggest that Apple's review system is biased in favor of men. 🏦 Financial Impact: This lawsuit could affect Apple's financial standing and reputation. Apple maintains it has achieved gender pay equity since 2017 through regular audits. Apple’s Stock Outlook: 📈 Stock Performance: Apple's stock is up about 10% since the WWDC 2024. Analysts give it a Moderate Buy rating with a price target of $209.28, implying a slight downside from current levels. Risks: 🚨 Legal and Regulatory: Apple’s legal and regulatory risks are slightly above the industry average, accounting for 21.4% of its total risks. Overall, the lawsuit adds to the legal challenges Apple faces, potentially impacting its financial health and investor confidence. 🌐📝 #Apple #GenderEquality #Lawsuit #PayEquity #AAPL #Investment #TechNews #WomenInTech

Last week I wrote a post about the importance of dealing with toxic employees quickly and compliantly. Thank you to everybody who sent messages to me on the topic, it seems there's quite a few businesses who have recognised they have these people, and need to do something to get the harmony in their team back. 🙏 There was one common thread in the messages. How do we avoid employing a toxic employee in the first place? ❌ There's good news and bad news! No recruitment process will unearth every potentially bad apple, but there are a number of strategies you can put in place to minimise the risk of doing so. Apple lays off over 600 California employees after shuttering car project Apple is laying off 614 workers in California, according to a new state filing, the company’s first significant round of job cuts since the Covid pandemic. The affected Apple employees worked at eight different facilities in Santa Clara, according to the WARN notice posted by California. The workers were officially informed of the cuts on March 28 and the changes are effective May 27, the filing said. Apple hasn’t been forced into the same kind of downsizing as its tech peers, largely because the iPhone maker grew more slowly than rivals during the pandemic. The filing comes weeks after Apple cancelled a long-running project to build an electric, self-driving car in a team called the Special Projects Group. While the California notice didn’t mention the specific projects where jobs are being cut, none of the locations in the filing are at Apple’s Cupertino headquarters, but at smaller, satellite offices more likely to house secretive initiatives. Positions that were cut include machine shop managers, hardware engineers and product design engineers, according to the San Francisco Chronicle. BLACKBERRY… A CAUTIONARY TALE I began my recruitment career in the early 2000’s recruiting sales professionals. A great grounding, and I’m eternally grateful for the experience in doing this!!! SHOUT OUT TO THE PRIME TIME RECRUITMENT LEGENDS Shaun S. Anna Jonas Jamie Allan Del Connolly Dan Cullingham Muatez Iain Hyslop Stuart Teasdale and many, many more! One of the ‘perks’ offered to sales professionals at the time was having a Blackberry phone. They were revolutionary, and I couldn’t wait to get one. FOR YEARS TO COME, THE BLACKBERRY BOLD WAS MY PHONE OF CHOICE… UNTIL APPLE LAUNCHED THE IPHONE!!! Last weekend I watched the film Blackberry. A story about the rise (and fall) of the business under the stewardship of one time Co-CEO’s Jim Balsillie and Mike Lazaridis… ONE THING REALLY STOOD OUT TO ME… And that was that the business, Blackberry, failed to innovate when they dominated the market. A level of arrogance set in and as a result, Apple absolutely wiped the floor with them in the proceeding years of the iPhone’s launch. IT OF COURSE GOT ME TO THINKING… About recruitment at the moment and our ability and in some cases, willingness to innovate… Just yesterday, our CEO, ‘Flynny’ was talking to me about a new innovative recruitment product about to hit the market. NOW… At the moment it seems every week there is a new tool and/or product hitting the recruitment market. Navigating the landscape of what’s good and what’s not in terms of Rec-Tech in itself can feel like a full-time job!!! UNDOUBTEDLY… Ai is changing, no has changed the World we live in, from recruitment through to healthcare, we will all benefit. It’s already engrained in my daily activities and tasks. ALTHOUGH, I AM OF THE STRONG OPINION… That Ai will NOT replace Recruiters! BUT… The generation of Recruiters that harnesses the power of Ai and integrates it into their day-to-day practices WILL replace the generation of Recruiters that doesn't. I guess the lesson I took from this worthwhile film watch is… NEVER STOP INNOVATING! No matter how successful you are!!! #recruitmentagency #recruitment #innovation

Could your company or managerial policies be a root cause of turnover or losing your best team members? The world of work has changed so much. If your policies/"rules" are not in line with the values of your staff, your retention rates for your top talent are probably low. Many companies are enforcing outdated or micromanaging policies like banning mobile phones or restricting email use and it is leading to more good people saying "I QUIT." Sure, there are some inappropriate things/behaviors that need to be enforced and mentioned - especially if they are interfering with performance - but companies should be hiring people they can trust to get the job done and giving employees a level of freedom that demonstrates that you trust them. Apple Lays Off More Than 700 Workers, Including Apple Car and MicroLED Teams: Apple is laying off more than 700 employees across the company, including its Micro-LED displays division and the recently shut down Apple Car project. 9to5Mac reports: As seen by 9to5Mac in the latest WARN report provided by the California Employment Development Department, the layoffs affect projects that have been in the news recently. For instance, Apple is laying off 58 employees from one of its offices in Santa Clara. This particular office belonged to LuxVue Technology, a company specializing in Micro-LED displays that Apple acquired in 2014. In recent months, we've heard rumors about Apple canceling its plans to design and produce its own Micro-LED displays for the Apple Watch. Bloomberg recently reported that Apple gave up on the project because the screens "were difficult to produce in sufficient quantities." There are also more than 120 layoff notices filed by Apple in San Diego, which aligns with a January report about the company having recently closed a Siri data operations office located there. The office was responsible for evaluating Siri's responses to users and for helping the company improve the platform's accuracy. At the time, Apple offered to relocate all affected employees to offices in Austin, Texas, if they agreed. Unsurprisingly, the shutdown of the Apple Car project (internally known as Titan) also resulted in layoffs. Some of the offices listed by the records were used by Apple to develop and test its electric car. The company had been actively working on building a vehicle since 2014, but the challenges surrounding it made Apple give up on the project earlier this year. The report notes that some of the engineers working on the Apple Car have been offered positions elsewhere at Apple. "However, not everyone has the chance to be reassigned since there were more than 2,000 people working on this specific project." The latest rumor is that Apple is exploring the development of personal home robots. Read more of this story at Slashdot.
