The Department of Health and Human Services estimates that over 70 million individuals will be affected by the new HIPAA Privacy Rule for Reproductive Health. To comply, Covered Entities (CE) and Business Associates (BA) may need to: ➡ Update BA agreements, ➡ Revise policies and procedures, ➡ Update their Privacy Notice/Notice of Privacy Practices (NPP), ➡ Update HIPAA training materials, and ➡ Implement the required attestation for applicable disclosures The new rule went into effect June 25, 2024. The earliest compliance date for CEs and BAs is December 23, 2024. Disclosures of #healthcare information in response to #lawenforcement demands are getting more attention. Why is that the case? In some instances because the specific records sought involve services to #patients that have become politically charged for better or worse. Is the disclosure a #privacy violation? The answer will depend on the circumstances of the particular request. Getting to the exact #HIPAA requirements is important to at least remove or understand one element. Appreciating the #regulations will not address the broader underlying problem, but it can take one issue off the table. https://lnkd.in/ewPfntdk
