On August 21, 2023, the Federal Consumer Attorney's Office issued an Advertising Guide for Influencers. The agreement serves as a consultation instrument for influencers and content creators, consumers, the general public, for due compliance with the provisions on advertising established in the Federal Consumer Protection Law. In Mexico, all the advertising and information provided by influencers is subject to various regulations, where the main one is the Federal Consumer Protection Law, since said information transcends the decision of the different consumers to purchase certain goods, products or services that are displayed. The Guide issued by the Federal Consumer Attorney's Office mentions different recommendations for publications on digital platforms and social networks, such as the inclusion of the hashtags #PaidAdvertising, #Advertising, #PersonalOpinions or #HostedBy, where applicable; and the different rules for different product or service categories. Do social media influencers and content creators need an attorney? Business attorney Raymond Panneton recently spoke to Rachel Rippetoe, senior reporter at Law360 about #socialmedialaw. Whether it's protecting intellectual property or guarding against potential infringement, negotiating contracts, fielding disputes with other creators, or keeping in line with #FTC and U.S. Food and Drug Administration guidelines, #influencers and #contentcreators need legal services, says Ray. "A lot of people overlook this as a practice area because they write it off as kids being kids, but the people who actually are making money on this, they really treat this like a job," he said. "I think our firm, and maybe small firms as a whole, are more attuned to those nuances. There's so many areas this touches on that you can't say, 'We'll just throw it in the pot of contract law.'
