WHO IS FROST LAW? It was pleasure to be on a virtual call today with tax attorney and CPA, Glen Frost. His firm of attorneys and CPAs, with offices in MD, VA, NY, PA, and FL, have been producing excellent content on the Employee Retention Credit since 2021. Both of our partner firms who process ERC filings also see Frost Law as a great professional resource. Glen shared that he does not expect IRS audits on ERC to be as big as many suggest. However, he believes the IRS may begin rejecting more filings or be slower to process. Why? He points out that the statue of limitations for audits on 2020 ERC filings is April 15, 2024; and the statue of limitation of audits for the first 2 quarters of 2021 are April 15, 2025. In other words, the idea of the IRS “clawing back” these funds over the next 5 years, etc is untrue… unless it’s fraud / criminal. There’s no limitation on fraud. For most employers, the only quarter that has a longer statute of limitation is Q3 of 2021, which is through April 15, 2027. And that’s only if you’re filing for that quarter.
