This afternoon the Public Accounts Committee, a select committee of the House of Commons, will discuss the value for money of the Government’s plans for Resource and Waste reforms in England. The PAC will hear from senior officials from the Department for Environment, Food and Rural Affairs on whether the Government has effective plans to achieve its resources and waste ambitions, and progress on collection and packaging reforms. I'm waiting on my flight to Dublin and I've been re-reading the great article by John Coates MCIWM, Re-Gen's External Affairs Manager, in the latest Materials Recycling World Future Thinking Supplement. Coming from a public sector background, he writes that joining Re-Gen was "a bit of a culture shock". He has been with the company for over six months and said that "the job is fascinating" and he's "constantly learning about things from a different perspective, such as the endless complexities of the packing recovery note (PRN) system. Working in the private sector you can make and implement decisions quickly and politics do not get in the way. All the politics now is at the national level". Never a truer word was written. He adds that England accounts for 85% of the UK’s waste. Changing the way it is collected, handled and reprocessed could make the largest difference to the UK in terms of reaching targets for recycling - and achieving a more circular economy. In this article, partner Llinos Kent and special counsel Kevin Pathinather explore the recent decision of United Resource Management Pty Ltd v Par Recycling Services Pty Ltd [05.10.23] NSWCA 236, in which the New South Wales Supreme Court of Appeal considered the issue of misleading and deceptive conduct in a commercial context. This case is a reminder that, where there is reasonable expectation that a disclosure should be made, silence can amount to misleading or deceptive conduct, even where a party may not consider that the other party needs to know about the matter as it would not have a material effect on the commercial transaction. How can governments leverage their huge buying power to help advance climate goals? Check this out:
We're so excited to see multiple PEN members and our colleague Elena Hoffnagle featured in this week’s Bloomberg News article on the intersection of sustainability and procurement! Local governments across the country have significant sustainability goals and enormous buying power, but as Bloomberg News reports, “even states and cities that do have guidance to consider green products often struggle to do so, illustrating the gulf between aspirational policies that exist on paper and the challenges of executing in the real world.” One promising example featured in the article is the City of Tempe, AZ, whose new sustainable procurement policy explicitly encourages staff to consider green products even if it costs more, which has resulted in 70% of the city’s custodial products being more sustainable. Other promising practices include the use of vendor pitches and short-term contracts for pilots in City of New York, City of Los Angeles, City of Long Beach, and City of Philadelphia, which allow testing out new green products at minimal risk to governments. Evidence of an urgent need for a Deposit Return Scheme in Wales is piling up – and visibly so. New research showed that drinks waste makes up a huge 46% of Welsh street litter. No wonder that campaigners are getting a little riled up at the prospect of any aligned UK DRS scheme sliding away. Just last week, the Government confirmed that the new target date is set at October 2027, as it had hinted in the past few weeks. Our latest article explains just why this is so annoying to certain people. Especially campaigners in Wales, which has been generally way ahead of the rest of the UK in its pursuit of Zero Waste and a circular economy. Of course, the fact that DRS in Wales, Scotland, or England are now further off should definitely not be an excuse to pause preparation. It is at least clear now that glass will be excluded from the aligned scheme... DRS already exists or is coming in in so many international markets, including Ireland recently. Each brings its own artwork and labelling management challenge, as well as returns logistics. Beverage brands facing a changing environment must recognise the importance of aligned artwork and packaging management processes and centralised data and specification management – or they will struggle every time a new DRS scheme goes live.
