There have been many detailed posts written today about the First Tier Tribunal decision to allow an appeal from Clearview AI (CV) against a decision to impose a penalty of £7.5 million for a breach of #UKGDPR. This case Clearview AI Inc v The Information Commissioner [2023] UKFTT 00819 (GRC) is complex and turned on whether CV was under the jurisdiction of UKGDPR when processing took place. As the case is some what complex and took me three reads to get the jurisdiction argument, I have distilled the main takeaway points for scholars and #DataProtection practitioners in my blog posting which address other issues than the complex position of "it is in scope or not" The key ones for me include: 👩⚖️ The tribunal attempting to set a literal definition for behavioural monitoring. 👩⚖️ The tribunal attempting to establish the legalities of #UKGDPR V #EUGDPR drafting. 👩⚖️ The role of the tribunal in such cases. 👩⚖️ The position of the Information Commissioner's Office in what was an expensive case to investigate and prosecute. Two days ago I had a pleasure to be a speaker at the conference "Is international law fair?" organised by European Society of International Law in Aix-en-Provence. During the workshop "EU as a global actor" I presented the paper co-written with Joanna Mazur "Role of EU Law in Regulating (Private) Facial Recognition Technologies for (Public) Safety". Our study provided an overview of the issues related to the use of facial recognition technology (FRT) for the purpose of fighting crime in the light of EU data protection law. As a case study, we looked at the decisions of the national DPAs in the cases concerning Clearview AI. These decisions provided an interesting material for the comparison of the approach to FRT when analysed from the perspective of its development by the private sector and its use by law enforcement. In relation to these decisions, we analysed the provisions of GDPR and LED which were invoked in these two types of decisions. Additionally, we confronted our results with the provisions of the proposed AI Act concerning the use of FRT for the purpose of law enforcement. #ESIL2023 #dataprotection #FRT #AIAct

I am delighted to see the Bill introduced to the US legislature. Couple of things that stood out from the definitions alone. 🔭 The scope is going to be, not unsurprisingly, smaller than EU law. Exclusions will include publicly available data, of which there is a significant volume. This bill is going to face some serious lobbying and including this data in scope would intensify lobbying against from organisations using publicly available data for their own purposes (think AI development). ❓ De-identified data will be out of scope. Not a surprise, in the US this term is generally synonymous with anonymised. In UK law it's synonymous with pseudonymised. Working as much as I do in pseudonymisation I was hoping for some alignment but alas that is merely my own niche problem to have. 🧔 Imitation is the sincerest form of flattery, and it's nice to see that the 'covered entity' has been more or less lifted from the GDPR. Sort of. There are all sorts of caveats. The scope won't include government organisations and small businesses. Given that in this day and age even small businesses can be involved in processing gargantuan volumes of data and that governments being excused from protecting rights and freedoms appears, well, odd. There will be more to dissect in the weeks to come!

The People’s Republic of China has moved ahead of other jurisdictions in regulating Artificial Intelligence (#AI) by enacting a set of regulations aimed at addressing risks associated with AI. The article by Esther Franks, Bianca Lee, and Hui Xu reviews three key AI specific regulations enacted in the People’s Republic of China (PRC) in 2022 and 2023. Together these regulations set out comprehensive obligations on the use of generative AI and algorithmic recommendation services in the PRC.
