On 28 November 2023, the Queensland Government released an updated waterway mapping layer relating to waterways that provide fish passage and the assessment of waterway barrier works.
In some cases, the new mapping indicates the presence of waterways (generally green / low risk of impact waterways) within proposed development sites for which detailed master plans and project designs have already been developed. While these plans / designs avoided waterway barrier works based on the previous waterway mapping, the newly released mapping now shows waterways within the footprint of proposed development.
This change of circumstance may require assessment of the waterway by a specialist fish biologist and expert advice to support the approvals process.

The River Corridor article I shared a teaser from a few weeks ago has now been published! In this review article, my co-authors (Vaughn Collins, Jeremy Payne, and Tim Abbe) and I propose a holistic approach to define a river corridor as the minimum space needed to sustain key river functions based on an understanding of the desired functions of that corridor and the processes governing channel and floodplain formation. I hope it will help guide how we think about land use around rivers.

Monitoring and surveying is important following a major incident, to prove the remediation activity is being effective.
In the last of our posts this week about our work on the Llangennech train derailment site we look at the comprehensive monitoring and surveying we employed to prove the effectiveness of the remediation strategy.
Over 100 regular monitoring locations were established to recover a combination of water and sediment samples, including SCAT surveys, to provide sufficient confidence on the success of long-term remediation.
We established shellfish monitoring for the commercial cockle beds as well as saltmarsh, bird, and invertebrate surveys.

Here's what you need to take into consideration:
-Federal and State Approval:
Any activity that affects wetlands or involves endangered species requires approval under the Clean Water Act and potentially the Endangered Species Act. This means securing permits from federal agencies such as the Army Corps of Engineers. Don’t overlook state-level permissions; depending on your location, this might involve the State
-Water Board or the Department of Fish and Wildlife.
Emergency vs. Standard Permits: In cases where a storm damages structures like culverts, quick action is necessary. Emergency permits can often be issued within a week, allowing for immediate repairs. Remember, these repairs must strictly replicate the original structure in size and type—any upgrades or material changes like switching from a culvert to a bridge necessitate a longer, standard permitting process.
-Preserving the Ecosystem:
It’s vital to avoid introducing new materials that can harm the ecosystem, such as concrete in sensitive areas. Emergency actions are aimed at restoring functionality, not enhancements or upgrades.
-Legal Compliance:
If urgent repairs are needed to prevent imminent harm to life or property, the law allows for necessary actions. However, it's imperative to promptly inform the relevant agencies with detailed photos and descriptions of the actions taken.
By following keeping these things in mind, property owners can ensure they meet legal requirements while protecting the environment and avoiding severe penalties for non-compliance.
