The law of the seed Take a look at an apple tree. There might be five hundred apples on the tree, each with ten seeds. That's a lot of seeds! We might ask, "Why would you need so many seeds to grow just a few more trees?" Nature has something to teach us here. It's telling us: "Most seeds never grow. So if you really want to make something happen, you better try more than once." This might mean: You'll attend twenty interviews to get one job. You'll interview forty people to find one good employee. You'll talk to fifty people to sell one house, car, vacuum cleaner, insurance policy, idea... And you might meet a hundred acquaintances to find one special friend. When we understand the "Law of the Seed", we don't get so disappointed. We stop feeling like victims. Laws of nature are not things to take personally. We just need to understand them - and work with them.

Private companies and their senior leadership are not immune to D&O liability claims. In recent years there has been an uptick in lawsuits filed by various stakeholders of the organization alleging oppressive conduct, bankruptcy-related claims, and employment claims for wrongful dismissal, change in working conditions, and harassment. The Oppression Remedy in particular is one of the broadest shareholder remedies in common law, and is being used by minority shareholders, creditors, directors and officers, and other claimants to bring a lawsuit against the organization and its individuals to remedy alleged oppressive conduct. 🔑 How to tell your client to NOT take a low settlement offer! In litigation, low offers for injury cases are the worst! From an attorney perspective, we fight for our clients and seek to get them justice and maximum recovery! Attorneys are bound to convey settlement offers to our clients so the hardest client conversations are always when a client is willing to accept an inadequate settlement offer! What do I do? I want my clients to understand that nothing is guaranteed in litigation but there are proper valuations and estimates for their disabilities and future medical care. For example, an insurance settlement for $250,000 may be a lot of money or not enough money depending on your injuries. $250,000 can be grossly inadequate to cover your labor-disabling disabilities and future medical care for the rest of your life. What is $250,000 over 15-30 years? How far will $250,000 go to cover worsening conditions that include surgery, further disability and need for a caregiver? What if you have a surgery later and you are disabled with a wheelchair? What if you lose access to medical insurance later and you are left without care? Clients ultimately decide to accept or reject settlement offers. Some of my toughest days are telling my severely injured client that accepting hundreds of thousands of dollars now is not in their best interest but this comes with a warning the case may go on for 1-3 more years without guarantees of future settlement amounts. I do promise my clients I will continue fighting for them until the end. After more than a decade of experience, I ensure that my clients are fully informed of their rights, projections for valuations, and ample time with qualified medical specialists to answer their concerns and questions.
