THE DOUBLE-DIP: It isn't uncommon for a public employee to retire from his or her employment, to be immediately re-hired into the position so that he or she may continue working while receiving employment benefits ( 🍧 often referred to as "double-dipping"). But what if that employee is in the competitive, classified service? This week, the Ohio Supreme Court held that the retirement of a municipality's fire chief created a "vacancy" in the position, triggering the requirements for filling the fire chief position prescribed by RC 124.48. Even though the fire chief only retired with the intent of receiving retirement benefits and had no intention of relinquishing his position, and despite the fact that the mayor "rehired" the retired chief the very next day and there was no change in payroll, once the fire chief submitted his retirement to the Ohio Police and Fire Pension Fund, the position was deemed "vacant" under the plain meaning of the word. The court also found that the city's charter, by its own terms, did not exempt the appointment of a fire chief from the competitive promotional-examination process. The court remanded the case to the court of appeals to consider additional assignments of error that it had found moot. While double-dipping in and of itself is completely legal, public employers should carefully consider this new decision and consult legal counsel when drafting employment policies, making employment decisions, and enacting or changing their charters. LPA Form 2: Do your Clients need it even if they say it’s “Too Expensive”?🤷🏻♂️ Recently, I came across a LinkedIn post that had the headline “𝗟𝗣𝗔 𝗙𝗼𝗿𝗺 𝟮 𝗶𝘀 𝗦𝗢 𝗘𝘅𝗽𝗲𝗻𝘀𝗶𝘃𝗲!” The points highlighted were good. And it’s true. Compared to LPA Form 1, Form 2 is much more expensive as it tends to be more curated. So I want to highlight this topic today: 𝗛𝗼𝘄 𝗱𝗼 𝘆𝗼𝘂 𝗸𝗻𝗼𝘄 𝗶𝗳 𝘆𝗼𝘂𝗿 𝗰𝗹𝗶𝗲𝗻𝘁 𝗻𝗲𝗲𝗱𝘀 𝗟𝗣𝗔 𝗙𝗼𝗿𝗺 𝟮? Majority of my clients (especially those who just do Wills) tend to go for Form 1 since it is easier to do + cheaper! But for clients who also set up Trusts, they do lean toward LPA Form 2. Why? Because these clients typically like to be more specific with their instructions. And like I said, LPA Form 2 is more curated and needs to be drafted by lawyers. You can put what your donee can and cannot do. Whilst Form 1 just leaves the decision making purely on someone else. It all boils down to how much control your clients want to have on their LPA—on how their properties, affairs, and personal welfare should be handled in the event of mental incapacity. Of course, this isn’t really a strict rule. Most of the time, people would just opt for Form 1 and then switch to Form 2 along the way (if they see the need for it). This is just some food for thought—an overview of how you can know whether your client will be keen to set up LPA Form 2 despite the costs. You know your clients best so you will be able to make the best judgment as to what they need. Go and add massive value to your clients! #financialadvisors #estateplanning #Singapore #LPA
