Data controllers and processors failing to file Data Protection Compliance Audit Returns (CAR) face the risk of exclusion from the National Data Protection Adequacy Programme (NaDPAP) Whitelist, along with penalties for non-compliance. The Nigeria Data Protection Commission (NDPC), in its commitment to uphold the rights of data subjects and foster trust in Nigeria's digital economy ecosystem, has initiated measures and recently issued a guidance notice regarding the filing of Data Protection Compliance Audit Returns (CAR) for 2022. The guidance, inter alia provides for the filing of CAR in accordance with the Nigeria Data Protection Regulation (NDPR) 2019, the role of Data Protection Compliance Organizations (DPCOs) in facilitating the filing of CAR with the Commission, focus area of the CAR, compliance memorandum, default fees and the effect of non-compliance. Therefore, data controllers and processors, spanning sectors such as banks, telecommunications, healthcare facilities, educational institutions, ICT companies, and data centers, are urged to take diligent notice and fulfill the necessary requirements.
