There are not too many areas of life where if you attempt something and fail miserably you are deemed successful, however in the criminal law, an attempt is treated quite the same as success. For example, s 11.1 of the Criminal Code 1995 (Cth) states as follows: "(1) A person who attempts to commit an offence commits the offence of attempting to commit that offence and is punishable as if the offence attempted had been committed." Say for instance you intended to import 10kg of cocaine into Australia, and it gets stopped by Customs at the border, you would be charged with attempting to 'import a commercial quantity of a border controlled drug', which carries life imprisonment and/or a fine of 7500 penalty units under s 307.1 of the Criminal Code in conjunction with s 11.1. Whether you were successful in importing the drugs or not, the maximum penalty is the same. There are a number of potential defences to these types of charges, and our office is able to assist in any state or commonwealth based charges.

According to information provided by #anticorruption officers to the #Realitatea press office, #investigations into customs inspectors at the airport have been ongoing since the end of 2023, and they connected 22 #criminal #cases in March 2024. #Authorities #suspect officials of #engaging in #passive #corruption and #influence #peddling.

On 15 November 2023, the European Public Prosecutor’s Office (“EPPO”) uncovered a EUR 200M customs and VAT fraud scheme. In this case from the EPPO, multiple locations were raided in Germany and the Netherlands to tackle an allegedly criminal organization that put in place a complex system to undervalue and evade custom duties and VAT. This is another case of the EPPO, launched in 1 June 2021, as the first new supra-national prosecution authority in the EU.
