I was adamant that I DID NOT want to build a law firm ❌. I hadn’t loved working in a law firm and when I hired law firms, as a client, I was often disappointed in the work product. It allows mothers, fathers, moonlighters, caretakers, and people who are partially retired to stay in the game. Because we offer this structure, we get the most incredible talent. 🌟 CLIENT SOLVE: Because we are fully remote, we are a super-low-overhead law firm. This allows us to benchmark our rates at about 50% of what they would be at our prior big law firms. Because of this, our clients can afford to have us in the mix more often, which allows us to learn all of the ins and outs of a company. Better legal advice comes from more intimate knowledge of your client’s business. If I recall, TheJudge Global arranged its first contingency fee insurance policy for a US law firm some 14 or so years ago. It was pioneering at the time, but since then litigation finance took centre stage. When is a Power of Attorney Needed and What does it do? Just any old Power of Attorney is not sufficient to buy, sell or convey title to real property. A Power of Attorney for healthcare decisions, for example, is meaningless when it comes to real estate matters as it does NOT grant authority to deal with the assets of the other party. Types of Power of Attorney: Limited/Specific Power of Attorney - Preferred- Grants only those powers specifically outlined to the transaction at hand and no other authority is given. For this reason, the Power of Attorney must specifically define the property, whether or not this property is to be sold or encumbered, and the authorities given. When the transaction requires reliance upon a power of attorney, it is vital that the document be submitted as soon as possible to the title company so that it may be reviewed. (Should not be older than 1 year.) A General Power of Attorney Allows the Attorney in Fact to act on behalf of the Principal for all phases of all of their business up to and including the sale or purchase of real estate. It will cover any property owned by the Principal. (Should not be older than 1 year.) A Durable Power of Attorney Is often given for healthcare decisions to be made in case of coma or other physical and mental incapacity. It survives the incapacity of the Principal if it contains the proper language. With regards to real estate transactions, it will be assessed on a case by case basis. Some terminology you should be familiar with includes: Principal: The person who grants authority to another party to act on his/her behalf. Attorney in fact: The person given the authority by the Principal to act as his/her agent. Other pertinent facts: A Power of Attorney cannot be used to act on behalf of a trustee of a trust. Since title insurance requires that the Power of Attorney be recorded, the document must be notarized. Any documents regarding the sale or purchase of a home that will be signed out of the country must be signed at an American Consulate. No Power of Attorney survives the death of the Principal. The statutory form provided in California’s Probate Code Section 4401 is the best one to use, provided that the appropriate and necessary boxes are checked and that the form is not modified. As with all complex legal matters, legal counsel should be obtained before making decisions or for complete review of such matters.

My post today is about class action law suits. I’m not a #lawyer but I understand the #law. This is not legal advice but if you need a referral to a lawyer I can refer you to trusted lawyers in my network. I’m making this post because I have a right to comment on any topic because I live in a free country. Class action law suits cause a heightened euphoria but truly the outcome does not benefit the plaintiffs. Before you get into a class action law suit ask yourself these questions: 1. Are your circumstances exactly the same as all the other plaintiffs? 2. How much in terms of the final court award will you personally gain? 3. How much time and stress will this add to you personally and to your family? 4. How much personal information will you have to part with and have it displayed publicly because the law suit is now public information. 5. Would you make more money if you spent that valuable time making an income than stressing over a court case that will take years to settle? The moment of truth comes when the court awards a huge amount to be paid to the plaintiffs and you get that cheque in the mail. Here is what I know: 1. One friend of mine was involved in a huge class action law suit where they were going for 500 Million. They won the case. After the legal fees and everything each person got a cheque in the mail for $16.56. What a shame? 2. Another one I know got a cheque for $49. If you’re pegging your life and your entire retirement on a class action lawsuit settlement think again. My suggestion: Look at your case specifically and how you were personally affected and have your own law suit based on your specific personal situation. Note: every time you go to court you don’t know what the other person will pull under the carpet against you. Don’t always think you will win. Evaluate many factors including your sanity. With that said: If anyone decides to sue you that does not mean you curl and cry. It means you consult a lawyer to know your exact legal rights. Be ready to pay the lawyers for consultation. Next steps: If you don’t know a great lawyer make sure to come to me because I know over 4000 lawyers in my network. I can refer you to a lawyer in any province. This message is for employers especially: Don’t forget to have insurance to protect your business against legal claims. Most class action settlements are paid by insurance companies on behalf of your company. The insurance company will put forward a fierce battle in court before they part with the money.
