GDPR at the EU Court: Authorities must enforce rules, but individuals cannot demand fines The Advocate General at the EU Court of Justice gave an opinion on the role of supervisory authorities in GDPR enforcement where a bank customer challenged the authority's refusal to impose fines against a German financial institution that had breached the protection of his data (Case C-768/21). According to the Advocate General: - Supervisory authorities must act against a personal data breach - BUT: authorities have discretion; they are not obliged to impose fines universally - Individuals do not have the right to demand the imposition of fines Be informed about the upcoming judgement!
