Construction Professionals: If you're an attorney, be up front and prepare your client for the true cost of litigation. Litigation is expensive. E-discovery is expensive. Depositions are expensive. If you're a client, don't be afraid to ask for this information, including budgets. Keep in mind that nothing ever goes as planned in litigation. So go back and compare performance against the budget periodically. And clients, yes, it really is that expensive. Sorry. I've never had a client at the end of litigation say "Wow! That was cheaper than I thought!" I have had clients appreciate me not hiding the ball on the cost.
