Which is more important Justice or Mercy? Justice and mercy are both essential elements in a fair and balanced society. However, in our quest for progress and social harmony, we must prioritize #justice as a politically powerful statement. While #mercy is admirable, justice ensures #accountability, equality, and the protection of rights for ALL citizens. Upholding the #principles of justice empowers us to address systemic #inequalities, fight against discrimination, and create a society that truly reflects our #democratic ideals and not the deep political corruption. Conventional wisdom assigns this responsibility to the courts, on the grounds that liberty can only be protected through judicial interpretation of bills of rights. In fact it is difficult for many people even to conceive of any other way that rights might be protected. John Dinan challenges this understanding by tracing and evaluating the different methods that have been used to protect rights in the United States from the founding until the present era. By examining legislative statutes, judicial decisions, convention proceedings, and popular initiatives in four representative states—Massachusetts, Virginia, Michigan, and Oregon—Dinan shows that rights have been secured in the American polity in three principal ways. Throughout the eighteenth and nineteenth centuries, rights were protected primarily through representative institutions. Then in the early twentieth century, citizens began to turn to direct democratic institutions to secure their rights. How can we have justice and accountability when the Supreme Court and judicial system again and again absolve a former president and countless others of responsibility? How can we expect equity when accountability is not present? The goal of accountability is to ensure the longevity of equity for those holding minoritized and marginalized identities. This is created through policies, practices, laws, and a separation of branches of government. The separation of powers and the ability of courts to impartially decide a process of accountability is the base of a democracy. Without accountability, we cannot have justice. The judicial system was never designed to create a systemic treatment of all people resulting in equitable opportunities and outcomes for all. The path to rebalancing power will require a reckoning and acknowledgment that reform is not enough. We need a clear and quick transition to a system that will hold those in power accountable for their actions, or we face the crumbling of our democracy. #democracy #justice #accountability
