New blog post! 🏴󠁵󠁳󠁣󠁯󠁿 What Colorado's New #AI Law Means for the #SecurityIndustry On May 17, Colorado Gov. Jared Polis signed into law Senate Bill 205, making Colorado the first state in the nation to enact a measure regulating artificial intelligence that is applicable broadly. The rushed process in Colorado prompted opposition from dozens of Colorado businesses, technology groups and AI startups at the Senate committee hearing on the measure, and opposition from national organizations like the Consumer Technology Association and the U.S. Chamber of Commerce, citing key areas of ambiguity that could make the measure difficult to interpret and comply with, and the creation of compliance risks across multiple business sectors. My thought's on the fall of Chevron Defrence cited in FedScoop: “Certain actions might change out of view, and we’ll never really know what those things are, but perhaps there are certain ambitions that might be scaled back,” Mittelsteadt said." This is a big change, and given the scope of AI activity across the government- and the government itself- its truly hard to see what might be impacted. That said, most if not all activities currently in progress under the AI executive order have legislative backing. 2020's AI Initiative act provides a solid ground for most efforts: "While neither action is spelled out directly in law, the activities of the NAIRR — which is aimed at providing resources such as cloud computing and data for AI research — and the AI Safety Institute are, for the most part, spelled out in the AI Initiative Act of 2020, Mittlesteadt said. " Meanwhile the Defense Production Act likely supports the administration's AI safety assesment mandates. "Mittlesteadt, however, said the law’s industry assessment provisions are “crystal clear” that the president has the authority to subpoena companies for information related to the defense industrial base." #Trust in the rule of law is a necessary condition for the citizens to continue to abide by the rule of law. In a recent paper, #TILT researcher Anuj Puri and Professor Esther Keymolen explore how emerging data-driven technologies undermine this trust. They examine the effects of systemic disinformation, algorithmic misgovernance, and the digitalisation of the social contract and suggest that the rule of raw has ceded space to the ‘rule of code’ understood in terms of power that the technical infrastructure exercises over the society. In response, they develop a framework to strengthen the trust in the rule of law in the age of #AI. The paper has been accepted for publication in the Cardozo Arts and Entertainment Law Journal.
