The Supreme Court’s ruling that allows Cites and Towns to enforce bans on outdoor sleeping is a big win for those jurisdictions and communities that have been dealing with the problems associated with the growing number of homeless. This ruling will allow Cities and Towns to address the crime and qualify of life issues surrounding homeless encampments and neighborhoods/streets/sidewalks that have been taken over by occupied tents and boxes through regulation and enforcement. Having laws regarding sleeping and encamping in public/outdoors is not cruel and unusual punishment. This is deeply upsetting. By rejecting this challenge, #SCOTUS is claiming that being unhoused is not a status protected under the Eight Amendment, which prohibits cruel and unusual punishment. #Homelessness is a complex, multifaceted, and most importantly, systemic issue, and this ruling targets an already vulnerable population of Americans. To quote Justice Sonia Sotomayor's poignant dissent: "Sleep is a biological necessity, not a crime. For some people, sleeping outside is their only option. The City of Grants Pass jails and fines those people for sleeping anywhere in public at any time, including in their cars, if they use as little as a blanket to keep warm or a rolled-up shirt as a pillow. For people with no access to shelter, that punishes them for being homeless. That is unconscionable and unconstitutional." We are in a time of frequent and alarming attacks on human rights. We must recognize these rulings for what they are - an undermining of basic rights that will not only affect certain populations, but our society as a whole. We must demand change.

Devastating. The enormity of this ruling is sickening. I hope that local leaders in every community in this country will step up to find the best local workaround to prevent the over-policing. But my expectation is that we will see an enormous rise in criminal enforcement, more jails and prisons being built to cope, and the leaders/profiteers of the prison industrial complex taking even more resources from the people living in poverty of this country. Make the middle scared of the people at the bottom and they will not have enough time or energy to be scared of the people at the top. https://lnkd.in/evjeN4jJ #MartinvBoise

I get the frustration over #homeless camps, and Sacramento has a huge problem with this, AND it's a major public safety problem for all involved; I just wonder if the DA is dealing with the violations directly? If there is shelter available, even the #Boise or #GrantsPass cases out of the 9th Circuit don't restrict enforcement of the law. An excellent piece about the upcoming Supreme Court case, Johnson v. Grants Pass. Cities and states are asking the Court to overturn decades-old precedent that says it's unconsitutional to criminally punish people for sleeping outside when they have nowhere else to go. First people are losing their homes, even with a job many have to sleep in tents or cars on public ground, and then they are criminalised for having no other choice, according to a recent decision by the U.S. Supreme Court from only 3 weeks ago. How cruel can a so-called democracy be, if the "demos", the people, are made criminals only because they do not possess (any more) what was taken away from them earlier? A good article from Clare Pastore reviewing the #SupremeCourt ruling in #GrantsPassvJohnson--a horrific, disgusting decision that ignores both the facts and legal precedent. It's a terrible loss that makes legal challenges to the criminilazation of homelessness proliferating across the country that much harder. But the case has also spurred tremendous organizing, building the coalition for #HousingNotHandcuffs. Fighting criminalization is critical, but the human right to housing is the real goal--and building broad coalition is essential. Onward. #Housingisahumanright.

More than a third of children imprisoned in Queensland have been living in unstable or unsuitable housing. More than half have been impacted by domestic and family violence. Almost all come from low-socio economic households. These are the children in Queensland's watchhouses right now. When children have their basic needs met, they are far less likely to engage in problematic behaviours. When they are kept out of prisons and watchhouses they are far less likely to reoffend. Programs such as Horse Whispering Youth Program and many others are Already making a proven difference, but we need continued funding to keep doing what we do best: supporting and making positive progress for the future of our communities. #safercommunities #community

If you're considering implementing a ban, it should serve the greater good of society. Many bans can clash with the freedoms outlined in the US Constitution. Banning the under housed isn't a solution; it worsens the issue. We should focus on uplifting and supporting the under housed, rather than disregarding them for the benefit of the more fortunate.
