Juries are notoriously mysterious and dealing with them is an art within itself. The purpose of a jury is to determine an issue of fact – not of law. Juries are always required to keep an open mind, listen very carefully to the evidence, and leave their sympathies and prejudices behind. In a criminal case, the prosecution have the burden of proving charges beyond a reasonable doubt. That is a burden of proof which is considered to be the highest standard and different to that in civil cases which is a burden of proof required on ‘the balance of probabilities'. In all criminal cases an accused is presumed innocent and is not required to prove anything. At the conclusion of hearing all of the evidence, juries retire to a jury room consider and then deliver a verdict of either guilty or not guilty. Expressing concern over the diminishing emphasis on cross-examination and proper trials, I find it disheartening to witness growing inclination towards “settling matters” , indirectly pushing parties to compromise without addressing the pertinent facts and laws. Recently, while presenting a TP at the Supreme Court, the judge emphasized on buying peace by paying the opposite side. While I acknowledge the value of amicable resolutions, and delayed trials costing years and years, it's crucial to remember that justice transcends mere financial transactions, even if it is a civil dispute or a matrimonial case. Sometimes, instead of opting for arbitration or conciliation, we must advocate for LITIGATION :)) #justsaying #Ranting

Law friends, I have two questions please? 1. Is lying in a submission to prosecution causing the withdrawal of a charge perjury? 2. If the respondent is related to the partner of the small law firm is this a conflict of interest? “Perjury is the deliberate giving of false testimony in a judicial proceeding. In Queensland the offence of perjury is codified in the Criminal Code 1899. If a person is lawfully sworn in as a witness, they can be found guilty of perjury if they knowingly make a false statement that could affect the outcome of the proceeding. This is the case whether the person is an adult or a child. Perjury is a very serious offence as it is capable of undermining the integrity of the judicial system and resulting in miscarriages of justice.” https://lnkd.in/gGeeheNQ
