I watched a trial today. After the jury was empaneled, the judge addressed the entire jury pool—chosen and unchosen— to thank them. Typically, this thank you consists of, “Thank you for your willingness to serve,” or, “Thank you for responding to the jury summons,” and the jurors are sent on their way. Today’s judge reminded everyone that the two most effective ways that citizens can engage and change their communities is through voting and jury service. He went on to say that the right to a jury trial is protected not only in the United States Constitutional, but the Constitution of Virginia as well. “If you or a loved one has an issue that requires a trial, you, your friend, or your family may want to have the case heard by a jury. And we cannot have jury trials unless the jurors come to court.” His speech was a gentle reminder that jury service is both a privilege and a duty. To you, the reader: If you receive a summons for jury duty, please do not ask me how to “get out” of it. Instead, please ask what you should do to increase the likelihood that you will get to serve. #trialattorney #juryduty #seventhamendment

Three time juror selectee here. How about paying the jurors a reasonable amount? Here in KY, you get $5 per DAY. There is no getting out of jury duty in this state. You might get it postponed, but by statute there is no getting out of jury duty. Most states are similar. It’s just insulting for the judge to drone on about the importance of jury duty and then find out you get $5 per day (and loss of your normal pay at your normal job -unless you are a government employee)

Courtney, first off, I miss seeing you everyday or so in Court! I’m so happy to see your growth and transformations in shaping our legal and societal community. I’d love to have a conversation, even publicly, about how traumas are affecting issues involving the very open-mindedness we want our jurors to have as they enter such important service. Can we talk about your takes and tactics in voir dire, the stage of jury selection where we try to uncover such hidden biases?

Courtney I have to appear for petit jury at 8:30 this morning. I don't know if I will be selected, but it's my first time being summoned, and I am actually excited

I totally agree...my husband just finished up a year of service on a grand jury. It was a eye opening experience for both of us. I have been called many times but not chosen. I would be proud to serve!

Great post! I have always believed that two of our greatest opportunities and responsibilities as a democracy are to vote in all elections and to serve on a jury to ensure our judicial process remains the greatest in the world. No system is perfect, but ours can only be successful if we participate and do so with an open mind. This ensures our system of law is fair and balanced.

I love Chief Justice John Jay’s approval of Jury Nullification as the public’s last resort to the imposition of bad law.
