CVSA's Operation Safe Driver Week is a safe-driving awareness and outreach initiative aimed at improving the driving behaviors of passenger vehicle drivers and commercial motor vehicle drivers through educational and traffic enforcement strategies and interactions with law enforcement. The next Operation Safe Driver Week is scheduled for July 7-13, 2024. The focus area for this year’s Operation Safe Driver Week is reckless, careless or dangerous driving. Any person who drives a vehicle in willful or wanton disregard for the safety of persons or property is driving recklessly. Careless/dangerous driving is defined as operating a vehicle without due care and attention or reasonable consideration for other motorists or people on the road. If you drive a vehicle* in Queensland, a police officer may require you to stop, to check that you are complying with the laws about driving.[1] Police officers should not use this power as a pretext to stop and search a vehicle. Last week, the Supreme Court held that a stop for a "licence check" was unlawful, where the officer had formed a suspicion that drugs were in the car.[2] There are several interesting things about a decision like this. For the public, maybe the most important is this - even if the police have a power to do something, their use of the power may be unlawful if it is done for an improper purpose.[3] *"vehicle" for this power, does not include a vehicle drawn by an animal, nor a train, nor a tram.
