Cooley successfully defeated an emergency motion for injunction pending appeal for Samsung Bioepis in an ongoing Biologics Price Competition and Innovation Act (BPCIA) litigation related to Samsung’s Soliris (eculizumab) biosimilar drug product. A Cooley team defeated an appeal in the US Court of Appeals for the Fourth Circuit, affirming a jury verdict finding white nationalist leaders and organizations liable to plaintiffs for egregious and hateful conduct at the 2017 “Unite the Right” rally in Charlottesville, Virginia. “We are extremely grateful that the court affirmed the jury’s verdict, finding all defendants jointly and severally liable for the racially motivated conspiracy to harass, intimidate and commit violence in Charlottesville,” said Cooley partner David Mills, who argued in defense of the verdict for the plaintiffs in the Fourth Circuit.
