Non-compete agreements have traditionally been enforced by Pennsylvania courts - particularly when they are kept narrow as to duration, geographic area covered, and the type of work covered. That may be changing. Today the Federal Trade Commission voted to ban most non-compete agreements, effective later this year. There is an exception for existing agreements with senior executives. I expect the new rule will be challenged, which could delay the rule’s effective date. If the rule stands it will be a significant change to the status quo.
