On 14th November 2018, Benjamin McQueen drowned during a military diving exercise. This resulted in a Judge-led #inquest held between 10-28 July 2023, during which 3PB’s Tom Horder represented the Health and Safety Executive. In a recently published Prevention of Future Death report, addressed to the Secretary of State for Defence, Sir Ernest Ryder, nominated Judge Coroner observed that there had been a comprehensive and far-reaching review of policies, practices and organisational structures which will have very significantly reduced the risk of future fatalities, however, Sir Ernest was concerned that 4 discrete areas met the threshold for a PFD report, as follows: 1. A stand-by diver was present at the dive exercise and he was deployed to try to find and rescue Ben. However, the stand-by diver had to surface having run out of breathable gas before Ben was found. A spare breathing apparatus cylinder was not carried in the safety boat for the stand-by diver (or other divers) to use in the event that the stand-by diver’s main cylinder ran out. (1) A stand-by diver was present at the dive exercise and he was deployed to try to find and rescue Ben. However, the stand-by diver had to surface having run out of breathable gas before Ben was found. A spare breathing apparatus cylinder was not carried in the safety boat for the stand-by diver (or other divers) to use in the event that the stand-by diver’s main cylinder ran out. 2. The progression of the dive training in which Ben was engaged was safety-critical. The progression of training was accelerated for several reasons, one of which was a visit by a high-ranking naval officer. The concern of the instructing staff was to polish the drills ahead of that visit and to take the pressure off the dive students by allowing them to practise the dive with relevant equipment ahead of the visit. This acceleration of safety-critical training in part because of such a visit was not appropriate. 3. Ben was lifted unconscious from the seabed and Cardio Pulmonary Resuscitation was immediately started. A defibrillator was also applied, but this was only available because it was carried by a Harbour Patrol vessel which came to assist. I am concerned that in such safety-critical military diving training, the dive support staff did not have available to them a defibrillator of their own either on the supporting safety boats or on land. This did not cause or contribute to Ben’s death but could lead to future fatalities. 4. There is an inconsistency regarding the minimum safety pressure level for the relevant diver’s breathing apparatus as between the maintenance manual for which DE&S is responsible and all other policy and safety guidance. #coroners #inquests #PFDreports
3PB's regulatory law and crime barrister Tom Horder acted for the Health and Safety Executive in the recently-concluded inquest into the death of Marine Benjamin McQueen. Marine McQueen tragically drowned during a military diving exercise in Portland Harbour. He experienced complications during the dive and was later recovered from the sea bed from a depth of about 18 metres. The Inquest, held over 3 weeks in the Royal Courts of Justice before Judge Coroner Sir Ernest Ryder, concluded that a number of failures contributed to his death including inadequate risk assessment for the combined use of equipment and a marked and inappropriate increase in the rate of training. The HSE had previously issued the MOD with a Crown Censure relating to the incident. Here's a note to be very careful as an expert witness. A recent case is an example of "expert creep" where an expert is well-qualified, but for whatever reason reaches out of their wheelhouse and opines in an area where they're not qualified. It could be that an attorney asked them to "stretch" on this one since he has so many other qualifications. The real problem lies in the fact that an affidavit was given...a sworn affidavit that was notarized...where the expert lays into an area that is nowhere on his CV or bio. Not a mention of this other area. No experience, training, or certifications at all. This guy had a wicked background in OSHA-related worksite safety, but none in trucking/transportation safety, and he went in depth on FMCSA regs and industry standards....but had absolutely no background there. Those who know understand that FMCSA and OSHA aren't the same and certainly aren't interchangeable. Use your imagination as to how serious this can get when a Daubert hearing is scheduled, or they proceed into depositions and the trial. Be happy with what you've accomplished, since just like with Stolen Valor in reference to military accomplishments, claiming more than you're worth can significantly cost you.

I remember being extremely nervous and unsure of how to handle being asked to be a Fire Dept. Lieutenant many years ago. I mean, being in charge of a crew was a heavy responsibility! One of my mentors told me - "Gregg, you know what you're doing on a scene, being promoted just means you assess the situation and think of the same things based upon what command needs to be accomplished and you simply delegate it to others and guide them." I've used that same mentality throughout life as well as the quick life vs death decision-making philosophy and skills learned to process through Denial, Deliberation, and come to a Decisive moment. Sometimes the decisions didn't quite work out, but we never hurt anyone or worse and always got the job done. In a life and death situation, ANY decision is better than none. Emergency Service jobs were never meant to be "decision by committee". Delays cause more harm or damage. The very skills we're all taught require quick courses of action, the ability to adapt and overcome, and in the heat of the moment, giving direct commands (NOT asking). Don't be the indecisive squirrel in the roadway. It never ends well.
