🇵🇹 Environmental groups filed a lawsuit against the Portuguese Government alleging the state’s overall failure to implement existing #climatelaws. 🔥 The coalition of NGO’s argue that since the approval of Portugal’s Framework Climate Law in 2021, the state has not enacted measures aimed at complying with the law and failed to adopt key implementation measures such as carbon budgets, a portal for climate action, a national energy and climate plan and sectoral mitigation measures. The group said the government hasn’t created a portal for citizens to track the status of regulation and publish a #carbon budget which would establish a #CO2 emissions gap as well as not having set up sector specific policies for #climatemitigation. ☀ Earlier this year a group of Swiss female pensioners brought a case to the European Court of Human Rights against #Switzerland, claiming that their country’s inaction in the face of rising temperatures puts them at risk at dying during heatwaves. 📚 We have witnessed a global trend of activists increasingly turning to courtrooms to challenge governments and #fossilfuel companies’ activities. Youth #climateactivists have played a central role, with 34 cases brought forward on behalf of children, teens, and young adults. According to a report by the UN Environment Programme and Columbia University, climate change lawsuits more than doubled in the last five years (around 2,180 climate-related lawsuits have been filed across 65 jurisdictions over the past five years compared to 884 cases in 24 jurisdictions in 2017). The US dominates with more than 1,500 cases, and about 17% of the cases were filed in developing countries. Environmental groups have petitioned the Constitutional Court to push the government to take more action on intergenerational climate justice, stating that the government's 23 to 25 percent reduction in greenhouse gases by 2026 to 2030 is too short on ambition. This comes after a government proposal to reduce emissions by 23 percent to 25 percent compared with 2005 was deemed inadequate by the groups. The goal for the third stage according to the Climate Change Response Act should have been set in 2024, and the groups say that the government’s unambitious goal would create a greater climate crisis for future generations. The groups have also stated that the legislative and executive branches have been overly passive about climate action. I like the way that Anel du Plessis kicked off this piece with the phrase "[t]he tentacles of the global ecological crisis reach everywhere...". A very apt description of the dire and insidious progression of environmental decay. I agree whole-heartedly with this characterisation but I fear it will be ignored by South African politicians vying for a piece of the new parliamentary phase. Where I am less confident has regard for Prof du Plessis' hope that, somehow, the next five years of governance following the May 2024 national elections will see renewed attention to environmental consideration and protection. I have zero confidence that this will happen. The next five years, with whatever blend of 'coalition' government emerges, will likely focus on trying to alleviate the economic and infrastructure chaos that the past 30 years has wrought. I believe there will be a continued effort to progressively weaken the environmental protections that we have. On a positive note, what the next five years might bring is an understanding as to how coalitions, or national unity governance, ie the product of collegiate thinking, can work to the benefit of the public interest . Should the benefits of such awareness become an established mindset only then can we perhaps anticipate more positive trends in collaborative environmental governance. Before that happens the rough ride our environment currently suffers from is going to continue for a while.

The EU faces a "greenlash" as opposition to environmental policies grows due to cost concerns. Passing new green laws becomes harder, especially with upcoming elections. The Environmental Industries Commission (EIC) have signed an open letter urging the UK Prime Minister to reconsider recent policy reversals and delay in implementing mandatory Biodiversity Net Gain. These reversals leave the country without a clear roadmap for net zero, which undermines the environmental, social, economic, and health benefits of climate action. It also casts doubt on the government's willingness and ability to meet its environmental targets. We call on the UK government to reconsider these changes and to work with us to deliver #netzero by 2050.
