🏠 Exciting News for Real Estate Professionals! 🏠
The real estate industry is abuzz with the latest announcement from the National Association of Realtors® (NAR) regarding the proposed settlement agreement to the Sitzer-Burnett verdict. This agreement is a significant development that aims to address concerns surrounding broker commissions and promises to bring about positive changes within our industry.
Key Details of the Settlement:
Coverage extends to over one million NAR members, state/territorial, and local Realtor® associations.
All association-owned Multiple Listing Services (MLSs) and qualifying brokerages are included.
The settlement awaits court approval, marking a pivotal moment for the real estate community.
But that's not all! The settlement also introduces additional provisions:
Implementation of a new rule prohibiting offers of compensation on the MLS, with compensation options moved off-platform.
Mandatory written agreements for MLS participants working with buyers.
NAR's commitment to pay $418 million over approximately four years, with no impact on 2024 membership dues.
NAR continues to affirm the benefits of cooperative compensation and its policies.

NAR Settlement Explained… (Part 2)
The misconceptions surrounding the recent NAR settlement are rampant, even being perpetuated by the news media and the POTUS himself! 😲
A lot of Americans are under the impression that the settlement eliminates the requirement for sellers to pay a buyer agent’s commission for the first time, which is NOT the case. Sellers have never been required or obligated to pay a buyer’s agent’s commission, although it is oftentimes in their best interest to authorize payment to a cooperating broker if their goal is to sell their home quickly and for the highest price.
It's my opinion that this settlement is NAR’s attempt to resolve the issue after realizing that a significant portion of its membership could’ve unintentionally misled their clients (and the general public) regarding how commissions are to be negotiated and paid. The uncertainty and challenges will likely cause the number of active REALTORS® to shrink dramatically in the near future. However, the agents that are able to pivot and remain in business will undoubtedly have a great opportunity to expand their market share while also working to return a high standard of excellence, accountability, and integrity to the profession.
As a REALTOR® myself, I have no intention of leaving the industry that I've come to know and love. The NAR settlement will be a powerful catalyst for meaningful and welcomed change.

The linked article is interesting and stimulating, and evidences what seems to be a large chasm between the general public and real estate licensees relative to the recent settlement proposed/tendered (which will result in modifications to business rules and practices) by the National Association of Realtors (NAR) and other large brokerages in the federal commission litigation. The full article is fascinating and worth a close read, but a good summary can be found at the start of the article, wherein it is stated: "There is a large gap between how the American public feels about the business practice changes outlined in the [NAR] nationwide commission lawsuit settlement agreement and how real estate professionals feel about them. According to a survey published by Clever Real Estate, 67% of the general public supports the changes, while 70% of real estate agents oppose them."

Going to leave this here as my first & last post about the NAR Settlement.
Here are 3 takeaways regarding the NAR Settlement from the #1 real estate agent in America:
1. Encourage Cooperative Compensation from your sellers - “Mr. or Mrs. Seller, if you want more offers on your house, I encourage you to offer something to the buyers agent.”
2. The people who will hurt the most are first time buyers and government loans (low down payments). There needs to be a restructure of compensation whether it comes from lenders or real estate disclosures, and/or seller credits.
3. It doesn’t make senes to perform Dual Agency on a transaction because there is nothing to gain. You are asking for potential lawsuits / disagreements, and dont get paid more for doing the work, no financial gain.
I wouldn’t be surprised if NAR fades away and we start to see a new national portal come to light! Stay positive and would love to hear everyone's thoughts!
