Seventy-five percent of attorneys who submitted public comment opposed change. I am not surprised. On Thursday, November 13, State Bar of California Board of Trustees will vote on whether to recommend an alternative pathway to licensure to the Supreme Court of California. The alternative pathway includes law school, followed by 750-1000 hours of supervised practice, and the submissions of a "portfolio" of required work product to be independently assessed by graders. In short, it is a direct assessment of attorney competence rather than an indirect assessment using a standardized exam. The proposal calls for a pilot program to test the assessment mechanisms and fine tune the requirements. The majority of those who oppose the proposal assert that "it will not protect the public." They make this assertion without evidence, without an understanding of psychometric values, and in many cases without even reading the proposal.
