I am beyond disappointed with today’s ruling by the 11th Circuit Court of Appeals in the American Alliance for Equal Rights’ (AAER) versus Fearless federal court case. The court's decision against Fearless Fund and the Fearless Foundation is a setback for women of color and all marginalized communities. While I have never been involved in the Fearless Foundation, when I co-founded Fearless Fund in 2019, I did so with immense pride. Helping to build the first venture capital firm founded by women of color for women of color was both hard work and “heart work” for me. And, while I am no longer affiliated with the Fearless Fund’s operations, I will continue to cheer the firm’s ongoing efforts to fight for those whom the system seems determined to keep down. As a Black woman who has had to fight tooth and nail for her own success, my message is this👇🏽 We CANNOT wait for some higher court or political body to grant us a path to economic freedom. If we must attain that ourselves with both hands tied behind our back, then that is what we will do. Because when you’ve built a life that neither Ed Blum or his anti-DEI agenda can disrupt, that’s the real flex. That's the American Dream. Despite today’s ruling, I am focused now more than ever on helping others achieve that dream. And though it may require new ways of thinking, doing, and being, failure is not an option. We stand with you Ayana. We appeal to a higher court than the arm of flesh. It is time for the Kingdom citizens to show up like David against Goliath and declare “is there not a CAUSE?” We shall not sleep on this. The Black Woman was the first Woman. We were and still are the epitome of creative power. You have won regardless of this report. No man can thwart the will of God! There is an entire government that backs you and your efforts. Continue to believe and receive wisdom from on high, on how to maneuver and conquer. 💕

Its always everyones great advice for black women to get their own, build their own, pull yourself up, stop waiting on a handout...weve all heard those talking points. But the reality is they really don't want you to do anything that would seriously help you to better yourself or other black women. Apparently pulling yourself up is now racist and hurtful to everyone else. Lol. Very interesting.

Question for the legal and policy experts. Does the decision stop FF from funding Black women or just affect what they publicly say about their funding strategy?

I am so disappointed in a system I work tirelessly to shatter these damn ceilings for. This nation is sooooo exhausting. Just know you have and are doing the right thing even if this nation does not hold its end of the bargain in creating justice and liberty for ALL. We see, we feel, we know it is just for some. But we must keep pushing it until it keeps its promise to ALL! ✊🏾❤️

This starts a dangerous precedent. If underrepresented communities cannot be targeted for charitable efforts due to race then veteran and disability are up next. Can you imagine the sheer number of Veteran non-profits that will be impacted? What about Schedule A or veteran preference for federal jobs? Is that also unfair advantage or "affirmative action"? What about scholarship programs that boost underrepresented candidates to compete in higher education? At its core, this ruling smells of anti-Black sentiment and rolls back centuries of efforts to even the playing field for the less fortunate. Sad day in history.

The potential harm this ruling could inflict on Black people and other historically underrepresented workers is immense. According to Courthouse News, Edward Blum is notorious for "court shopping," a tactic where he exploits the judicial system by filing lawsuits in courts that are likely to rule in his favor. This antidemocratic maneuver allows wealthy individuals to undermine policies and programs by leveraging friendly courts, often resulting in antimajoritarian decisions. As noted by AJC, the 11th Circuit Court has a conservative history, particularly in rulings related to race and affirmative action. This is a clear example of how minority rule by a dwindling right-wing extremist sect can take hold of all our systems of governance. It is particularly ironic given that the court systems of America, once seen as a safeguard, are turning out to be the most susceptible to this manipulation, especially given the numerous judicial appointments during the last presidential administration. How are we uniting to support the Fearless Fund? Does anyone know of ways folks are organizing to counteract this?

Ayana Parsons No it is NOT a set back for woman. You can serve those who are of different langauage and cultural groups. It’s only a set back for women with a self serving purpose. Now funding will go to those who are historically underserved only. ‼️ You can serve indigenous language groups for example or “Haitian Speaking” verse “black” 🧠 Anyone who is set back by this isn’t very bright. You say you are a Christian. God isn’t partial.

What angers me the most is the intellectual dishonesty this case is based on. If AAER truly wanted equal rights they would go after VC firms that have exclusively funded white males. The idea that a fund which unapologectially supports a segement of founders who get .34% of VC investment is illegal is nasty work. We must contnue to fight this nonsensical attack on Black Women. HUGS!!!
