Yesterday, I attended an incredibly informative Canadian #hr Law update webinar hosted by a reputable firm in the Toronto area. Here are some key takeaways for the #people professionals in my network: 1) Bill 79 - Working for Workers Act - Breach of the OHSA:The maximum fine for corporations under the Occupational Health and Safety Act (OHSA) has increased from $1,500,000 to $2,000,000. 2) Bill 149 - Amendment to the ESA - Pay Transparency: This bill is part of the broader Pay Transparency movement in Canada, successfully implemented in BC. While Ontario hasn't released specifics, it will likely require all public job postings to include compensation and/or salary range. I highly recommend organizations proactively adopt pay transparency measures. 3) Bill 149 Amendment to the ESA - Removing "Canadian Experience": Eliminating the requirement for "Canadian experience" in job postings may be deemed a breach of the Ontario Human Rights Code, as it discriminates against immigrant populations and their skill sets. 4) Workplace Investigations: Ensure your in-house HR team is trained in conducting workplace investigations, both from a legal and due diligence perspective.
