Throughout the 2023 state legislative session, we tracked 200 bills seeking to address hospital and health system costs, including bills on facility fees, health care market oversight and certificate of need, and 340B transparency. Happy Thursday! Here’s what we have been following this week at HealthLeaders. With all the historic rulings coming out of the recently adjourned Supreme Court of the U.S. session, it would be easy to overlook the long-term ramifications of one of the most important decisions handed down: The overturned #ChevronDeference. Think because you’re in #healthcare you’re off the hook? Not so fast. The ruling, which transfers that authority to interpret that ambiguity to federal judges, could affect literally every area of #federaloversight, including healthcare. And, it's not exactly clear how all this will play out. #Medicalassociations are warning that the ruling will significantly disrupt publicly funded healthcare programs to the detriment of #patienthealth. Hospitals, for example, will now potentially have to wait through legal challenges for regulations that were previously determined by the many federal agencies that influence healthcare. G Hatfield, who previously worked on our environmental, health, and safety publication (Hi, EHS Daily Advisor!), was the perfect person to analyze all of this for our healthcare market (https://lnkd.in/eDY2vJsw). Also, after more than a decade of haggling, long-standing barriers to #telehealth adoption in Pennsylvania are coming to an end (https://lnkd.in/en7cfpa7). In addition, we have been following Cano Health for years, and the primary care provider, which reported net losses of more than $750 million in the second half of last year, has now exited #bankruptcy as a #privatecompany with a focus on its Florida market. The company said it converted more than $1 billion of debt into common stock and warrants, while investors have committed more than $200 million (https://lnkd.in/eAB-ugN8). To generate liquidity, the provider left #unprofitablemarkets In Texas, Nevada, California, New Mexico, Illinois and Puerto Rico, and also cut 20% of its workforce. Apparently, it worked. On the national scene, as I’m sure you heard, the Federal Trade Commission plans to sue the nation's three largest #PBMs. The FTC isn't commenting, but on Tuesday the commission accused PBMs of manipulating the drug supply chain to enrich themselves at the expense of smaller, independent #pharmacies and patients. As many people know, private equity firms focus primarily on making money. While there’s nothing wrong with this, it can lead to problems when private equity firms invest in healthcare. In these cases, patient care can fall to the wayside in place of profit. OB-GYN Vernon Cannon and DuPage Medical Group’s misconduct is a perfect example of this. Despite numerous reports of abuse, Cannon was able to continue practicing, which resulted in even more victims and cases filed against both parties. The individual terminates employment with Company A and is offered COBRA. Can the person elect COBRA with Company A even though they are enrolled in another group health? Yesterday, Families USA’s Senior Director of Health Policy, Sophia Tripoli submitted testimony to the Pennsylvania Office of Attorney General in advance of their public hearing on January 18, 2024, on the proposed integration and affiliation of Washington Health Care Services, Inc., into the University of Pittsburg Medical Center (UMPC). Amidst an ongoing health care affordability and quality crisis in Pennsylvania and across the nation where unchecked consolidation has led to large medical monopolies and high and rising health care prices, we urged the State AG to oppose the proposed merger and any mergers and acquisitions that lead to more concentrated health care markets that threaten the health and financial security of families. State Attorney Generals, including the PA Attorney General, play a critical role in overseeing health care markets, promoting healthy competition, and serving as a backstop against widespread industry consolidation and anti-competitive practices that are too often employed by large health care corporations and hospital systems.
