Remember, the faster you drive, the less time you have to react. And while you might feel invincible behind the wheel, safety structures have limits to how much they can protect you. The most recent Homicide in London/Canada. The current information: Two males engage in what appears to be a consensual fight - in Canada this is legal (sort of). In essence, you CAN engage in a fight (think hockey game - almost every, single NHL/OHL/AHL game), but you CANNOT consent to bodily harm - typically interpreted to require an injury requiring medical intervention (confusing isn't it)? Do police charge people for fighting? If the injuries are serious enough, but most often, no, there are simply TOO MANY and not enough police to deal with the reality of "street fights." Ages: Deceased 20, accused 40's Location: Downtown, outside of a nightclub, on the street. Scene: Low light, asphalt, minimal vehicle traffic, uk persons in general area Time: 1:20 a.m. Video: Two males "square up" no weapons beyond physical force. Reason for fight - not currently advertised. The two males have a very short, quick fight, the deceased falls after one punch, regains his composure, returns to fight, and is knocked down with what appears to be another punch (grainy video). The deceased dies several days later while in hospital. Accused is charged with MANSLAUGHTER. Q: Will the accused be convicted? A: The evidence and the courts will determine the outcome. Q: Would you choose to have the trial in front of a single judge, or a jury of peers? A: My opinion - in this type of case, jury, (based on my current information). Statement? Did the accused provide a statement? Unknown. If he did, it can play a significant role in his case moving forward, or as evidence for the defence. To be addressed: 1) Was the force reasonable? 2) What did the autopsy determine - such as did the male die from a drug/medical issue not obvious to the video observer, or shared publicly? 3) Did the accused have a reasonable opportunity to avoid the confrontation? And why was that option not exercised? Perhaps he could not outrun the deceased, or he had attempted and the deceased had "caught up with the accused" (two basic considerations). 4) Did the accused perform any other assaultive actions not presented from the grainy video (witnesses may have more to add) or was it a "one/two punch fight" and someone dies? Yes, this does happen, in our city, every couple of years. Noteworthy: this incident did not appear to have a "head stomp" or "beating post knockdown" it appears a stand up, couple of punches, with one man dying, and another charged. The prosecution must assess all evidence in totality, and determine if they have a reasonable probability of conviction. Will experts be involved? Most likely. What are your thoughts? If you engage in a fight, and it is consensual (this appears so, but it may not be), should someone be charged with manslaughter and "let the courts decide?" Not an easy case to prosecute. I am certain neither party anticipated this horrific outcome, 1 man's life is lost, another facing prison. I can't help but wonder WHY.....?

Another tragic story in North Texas this week. A wrong way driver caused a major head-on collision killing two people and seriously injuring a third early Monday morning. Sadly, wrong way collisions are a problem in Texas with many of them due to drivers being under the influence of drugs or alcohol. In fact, according to AAA Texas, the state leads the U.S. in wrong-way crashes. A recent study found there has been an increase in wrong way collisions since 2015 and researchers believe that a rise in intoxicated driving is likely the primary reason. And, while head on collisions only account for approximately 1% of all collisions in Texas, they are disproportionately likely to lead to catastrophic injuries and deaths. In 2022, there were 636 people killed in head-on collisions in Texas. Every single one of these head on collisions is avoidable and we all need to do our part to prevent them from happening.
