There are a lot of stories (see here and here, for example), about the State of Hawaii official -- the Deputy Director of the Commission on Water Resource Management and an employee of the State Department of Land and Natural Resources -- who allegedly refused for several hours to release water as requested to fill reservoirs, until first obtaining the approval of a taro farmer. A lot of the reaction has been of the "how could this be?" variety. How can a government official refuse to release water needed for fire suppression? This suit is an interesting case study for the Public Trust Doctrine. If the Plaintiffs succeed, it would likely mean all of the large municipalities surrounding the lake and its tributaries will see their junior priority water rights curtailed, while senior agricultural water rights remain intact. Septic systems are one of Indiana's frontline defenses against water and groundwater contamination. Unfortunately, many of the state’s systems are outdated and failing. As these systems age, inspections should be conducted to ensure they are still functioning correctly. Case study: Otterbourne water treatment works in Hampshire extracts water from the River Itchen and concern was expressed by the Environment Agency about the potential for fish, particularly salmon smolt, being drawn into the intake.
