Another piece of terrible legislation that the wholesalers are trying to implement in New York. "Summary (2023-07-19) Requires that alcoholic beverages imported into New York be first delivered to a licensed New York state wholesaler and maintained at a premises or warehouse operated by the wholesaler for a period of twenty-four hours." https://lnkd.in/gWsMzRHy Adds absolutely no value to distribution but is targeted to prevent the inevitable self-distribution for small craft producers. It used to be these "bump the dock" rules were for tax and bookkeeping purposes. Its is now not needed due to fabulous electronic tracking. Even those trying to create systems to help self-distribution will be defeated by this terrible attempted move to build barriers and remove competition. The 21st Amendment and the Commerce Clause are on a collision course that meets at the intersection of direct-to-consumer (DTC) shipping. A divergence of opinions erupted from the Granholm Supreme Court case in 2005, which made it clear that states cannot discriminate against out-of-state wineries when determining who could and who couldn’t ship direct to consumers in each state. The Supreme Court, however, never provided a definitive answer on wine retailer DTC shipping. Sad but true dialog from today. This is between a producer and a customer in another state. Winery "We need a distributor in those areas and none are interested. We have called and only one responded and then ghosted us." Customer "Can you call XXXX and YYY direct. I only say those 2 spots because they are huge! They do wine tastings that you could do that will help sell the product. Would ZZZ work with you? How about the AAA? We have purchased many wines thru the tasting that they offer during that event. I think you would kill it there! Nothing compares to your wine" Winery "We need a distributor. They need to pick up our products so they can legally be brought into the state. We can’t contact local stores because the only do business with distributors." Everything is wrong with this in the alcohol beverage industry. If a producer cannot get a distributor in a state, they are totally locked out, with no opportunity to self distribute.
