Interesting that it take effect Feb. 1, 2026. Why not for 2024 election? Should this also be extended to other important communication like Finacial communication. Ken Fricklas S.B. 24-205 is part of Colorado’s Consumer Protection Act, which also includes the Colorado Privacy Act. If Gov. Jared Polis signs it, it would take effect Feb. 1, 2026. A piece of legislation on “candidate election deepfake disclosures,” House Bill 24-1147, has also passed the statehouse. It seeks to curb deepfakes or AI impersonations in political communications. The bill would make deceptive portrayals of presidential candidates potential crimes of perjury and forgery. It would also impose civil penalties for sending out any communication regarding a candidate for elective office, using deepfake technology. The bill headed to Polis’ desk May 15 for his signature. https://lnkd.in/gNvn3NEp

Somehow, we as the human race, seem to not have advanced very far at governing global challenges, such as AI.. but we are trying. In situations (and meetings) like these it seems so obvious how power, money and interests live in some demoracy vacuum. What’s wild to me is how the systemic structures are reinforcing themselves, now with the power tool of AI. But at the same time it is also showing those mechanisms more clearly which makes it easier to see the need for new ways of solving hard questions that concerns a whole planet. I’m curious who decides on the invite list for such meetings? Probably a naive question - but I’d start there - have a diverse team decide on 1) the invite list and 2) the agenda. The process itself needs to be more democratic.

How Law is Supposed to Work in the U.S. and then There's This. How it's supposed to work: Government representatives identify an area of commerce that needs regulation. Congress debates a bill (after related committee work) and passes a law setting out clear national policy. Lobbyists lobby. The President signs or vetoes such bill. Relevant regulatory bodies propose regulation and, following administrative law procedures, ultimately promulgate regulation. Judicial review may or may not occur. How it currently works: Lobbyists lobby. The White House issues an Executive Order under the Defense Production Act without Congressional involvement. Executive agencies issue related regulation relying on that Order with barely a concern about their jurisdiction, the lack of Congressional policy imprimatur, or the "major questions" doctrine. Congress does nothing about this usurpation of its authority.
