Today's Supreme Court decision overruling the 1984 case of Chevron v. Natural Resources Defense Counsel is likely the most important business regulation legal development of the last 40 years. The premise of Chevron was that administrative agencies possess the technical and policy expertise to interpret statutes, and thus courts should defer to those agency interpretations in judicial proceedings. Now, agencies must convince the courts that their expertise is valid, with regulated parties able to present more substantive counterarguments. Recent changes to the Federal Rules of Evidence inject even more uncertainty into that process. I explored some of the risks of these changes with colleagues Olen York, Susan Lanham, PhD, MAFF, CDFA, and Dex Gruber in an article published last month.

I recently engaged a comparative analysis index for a class in my Masters Program Butler University. I was fascinated (and disheartened) to learn the perception of the Rule of Law in the modern world is generally degrading. Strengthening our legal system worldwide seems like an arduous task, but not an impossible one. Regaining out sense of fairness, consent to be appropriately governed, and personal accountability seems like a good place to start. 🎓✍️ I am thrilled to announce the publication of my article in a Q2 International Law Journal! This piece represents a significant milestone in my academic journey, particularly as it marks the culmination of my first compulsory year in Civil Procedure at the renowned Faculty of Law, University of Coimbra. The article delves into a comprehensive case study, focusing on the jurisdictional challenge in the UK courts concerning the MARIANA DAM DISASTER [2022], currently the most important collective redress action in the EU courts. This research reflects my dedication to understanding complex legal frameworks and my commitment to providing meaningful insights to the international legal community. I am immensely grateful for the support and guidance of my professors and colleagues at the University of Coimbra, whose mentorship has been instrumental in this achievement. I'm also grateful to Pogust Goodhead, the firm I've been with since the beginning of this case, for helping the victims to get full justice against the polluting companies finally. As we navigate through an increasingly interconnected legal landscape, I hope my research offers valuable perspectives on jurisdictional challenges and contributes to the advancement of international civil litigation discourse. The framework for transnational litigation in environmental and climate change civil liability is a reality in these years, and we should be prepared to understand how developed countries can protect these citizens and the environment from the colonizing behaviour of unfriendly corporations.
