Sustainability is getting “hotter and hotter” - just like our planet. While EU, UK, Australia and a few other jurisdictions lead the way in terms of regulation, we all need to chip in. I am delighted to continue contributing my small but keenly enthusiastic bit to our firm’s Sustainability offering to support and align with clients’ aspirations, commitments and values. Before this June evaporates, please allow me one last Pride post. Our LLAN Pride event was incredible. My particular gratitude goes to our wonderful Ashurst team for phenomenal support and to everyone who joined & enjoyed.
On 27 June, LLAN - Lawyers for LGBT and Allies Network hosted a screening of EGOIST, an amazing award winning Japanese movie about love, family and loss. This screening was our marquee Pride event. We are very grateful to our generous sponsors - Ashurst, Herbert Smith Freehills, Morgan Stanley and Nikko Asset Management Group - as well as over 200 attendees who seemed to have enjoyed the movie and meeting one of its stars - Durian Lollobrigida. During our 2023 Equality Gala, LLAN awarded Ryohei Suzuki with the Equality Champion award for his lead role and support of marriage equality. Suzuki-san's acceptance message was re-shared with the audience. No matter how big or small, each Pride celebration sends an important message of support and love to the LGBTQ+ community. Let's keep encouraging, promoting and celebrating our uniqueness and diversity. Happy Pride!

Affirmation - Affiliation - Affection Congratulations to Temple University Japan and Dean / CEO Matthew Wilson (pictured) on another succe$$ful Diamond Dinner fundraiser for students (including 9 Ukrainians), on doubling the student body and on opening the Kyoto Campus. These incredible achievements provide further affirmation of Temple Uni’s leadership and innovation globally and in Japan. For the past five years, I have been teaching International Compliance at Temple University - James E. Beasley School of Law Japan Campus. I remian truly proud of this affiliation and of being part of TUJ’s adjunct family. Gladly, the affection seems mutual. Students’ official feeback indicated praise for “phenomenal energy”, “incredible speakers” and “inclusive environment”. And, above all, it confirmed that “international compalice is very, very interesting”. Thank you, Temple’s amazing team and students! In my multi-year experience, post 40 birthdays are less about fun and more about reconnecting with family/friends and pondering about the “big picture”. This year it was all of the above thanks to the gorgeous 💙💛 flowers from our amazing Ashurst Tokyo team, delicious 🎌 dinners with clients, and the company of a dear friend and inspiration 🇬🇧 The Lord Nick Herbert. Since we can’t stop aging, we can try to enjoy the process. And the “big picture” is actually pretty good - thanks to you all 🙏🏾

OFAC Amends Reporting Requirements with Eye for Sanctions Evasion On May 10, 2024, OFAC issued an interim final rule to amend the "Reporting, Procedures and Penalties Regulations" of 31 CFR Part 501. Notably, OFAC will require a report within 10 business days from the date of a transaction that unblocks, or transfers blocked property, including "pursuant to a valid order issued by a U.S. government agency or U.S. court." OFAC explained that these new requirements will help determine the current status of blocked and unblocked property, helping OFAC tracking transactions of property owned by sanctioned individuals or entities. These changes will come into effect on August 8, 2024. A likely impact is that any unblocking related to sanctions russian parties will / should be subject to higher scrutiny. The added reporting requirement applies to any "U.S. person," who are required to block such property in the first place. The reports must detail the person holding the property prior to the transfer or prior to the release from blocked status, the date the property was transferred or unblocked, a description of the property and of the transaction, as well as the SDN at issue. The amendments also clarify the definition of U.S. persons, which includes U.S. individuals and U.S. businesses as well as U.S. financial institutions. OFAC also clarified the scope and types of rejected transactions reportable by non-financial institutions, which include transactions involving securities, checks, foreign exchange, and sales or purchases of goods or services. OFAC also revised the procedures to request the release blocked property because of mistaken identity, typographical, or similar errors. As it has recently publicized by sanctioning proxies of Russian oligarch Oleg Deripaska, OFAC has targeted SDNs and their proxies who try to put together elaborate sanctions evasion schemes to unblock property by operation of law. The new requirement to report transactions that unblock property allows OFAC to keep an eye on sanctions evaders and gain an opportunity to quickly respond to (likely) sham transactions. We would encourage any person involved in a transaction that would unblock or transfer previously blocked property to conduct thorough due diligence to ensure that the scheme is bona fide, and to avoid sales and acquisitions to shell companies or proxies with links to sanctioned individuals. Such links would surely be difficult to uncover, but OFAC now made it clear that any such transaction merits a higher scrutiny from the participants as well as the mighty OFAC itself.
