Another feather in the cap! We are happy to inform that we successfully got injunction order in favour of our Client Vaidrishi Laboratories Private Limited. A tough case where the Defendants had registered the Trademark Vaidyarishi in classes other than in which our Client was operating.  The court had to see can a registered proprietor of a trademark take action against another registered proprietor. The Defendants also registered the domain name www.vaidyarishiindia.in We argued extensively on Section 29 (4) and (5) of Trade Marks Act. The Court of Hon'ble Judge Hemani Malhotra issued the interim injunction in favour of the Plaintiff. The Court also directed the domain name registrar to suspend the domain names www.vaidyarishiindia.in till further orders. Mr. Sumit Nagpal argued the matter with the able assistance of Ms. Aastha Sood.
