Description Of Job

The Salary Range for this position is :

$27.74 - $33.13 Hourly

$2,219.54 - $2,650.15 Biweekly

$4,809.00 - $5,742.00 Monthly

$57,708.00 - $68,904.00 Annually

The Job Protection and Retaliation Investigations work unit within the Policy Unit of the FAMLI Division, exists to receive, identify, and investigate complaints alleging retaliation and interference under the FAMLI Act. This work unit consists of investigators who ensure employers are not engaging in prohibited activities such as retaliation or interference, and ensure that employees can pursue remedies for these violations in a no-cost, alternative forum to the judicial system.

This position is a fully operational compliance investigator, processing complaints and inquiries received by the Division (hereinafter referred to as “cases”). This position conducts investigations for compliance with the FAMLI Act and its regulations, and the position’s work involves identifying, collecting, analyzing, and summarizing evidence to determine if a violation has been, or is being, committed.

This position reviews and analyzes cases. This position determines how to conduct the case investigation and what action should be taken as a result. This position determines what information is required from the parties involved in the case. Parties involved may include claimants, employers, attorneys, employee and employer representatives, and organizations. Within limits set by the specific process, the investigator decides what operation is required to carry out and complete the case investigation. After the investigation, this position decides and writes an investigative report and makes a recommendation to the unit supervisor regarding a proposed outcome. This position will draft determinations. The investigator’s determination is reviewed for accuracy, legal analysis, writing, etc., and then once approved, sent to the parties involved in the case. The investigator’s determinations are subject to review through the Division’s appeals process and the Colorado court system. During and after the case investigation, this position is required to collect and maintain all relevant case documentation.

This position also provides education to claimants and their representatives, employer and business organizations, and other private and public/governmental entities within the State of Colorado.

Minimum Qualifications, Substitutions, Conditions Of Employment & Appeal Rights

COMPLIANCE INVESTIGATOR I (H6K2TX)

Experience Only

Five (5) years of relevant experience in an occupation related to the work assigned to

this position such as a legal experience in government agency, including investigations, compliance and may include employee relations.

OR

Education And Experience

A combination of related education and/or relevant experience in an occupation

related to the work assigned equal to five (5) years such as a legal experience in government agency, including investigations, compliance and may include employee relations.

Preferred Qualifications

  • SHRM Certification , EEO Certification, Juris Doctor
  • Bilingual in Spanish (Read, Write, Speak)
  • Experience in legal writing, analysis and comprehensive investigative reports
  • Experience in collaboration with multi level leadership setting/project collaboration
  • Experience performing similar duties as a State of Colorado classified employee.

Competencies

  • Experience conducting investigations in a government agency or an employee relations role investigating retaliation and interference claims. (This includes interviewing multiple parties , developing investigative strategy and assessing the strength of the claims and evidence at all phases of the investigation.)
  • Experience writing investigative reports or determinations and applying facts to the law.
  • Experience interpreting and applying statutes, rules, and regulations.

APPEAL RIGHTS:

Review of the completed, signed and submitted appeal will be timely on the basis of written material submitted by you, using the official appeal form signed by you or your representative. This form must be completed and delivered to the State Personnel Board by email at dpa_state.personnelboard@state.co.us within ten (10) calendar days from your receipt of notice or acknowledgment of the Department’s action.
