Bushnell Nielsen provided a review of significant case law development related to various key policy provisions. In addition an all-star team of in-house counsel retention panelists discussed the topic: "Getting and Staying Retained: Best Practices for Outside Counsel." Jerel Hill also presented his all-important case law update of the Top 25 title insurance cases of the year.

Reserving Rights of Title Insurers in Third Party Actions: When and How to Do It and the Ethical Implications for Retained Counsel

The article discusses the implications of a title insurer assuming the duty to defend an insured in the event of a third party claim or litigation adverse to title and the limitations of the insurer’s duty based on the insurer providing notice of a reservation of rights that the insurer is accepting the defense of a tendered claim but is reserving its rights to deny coverage at a later time on specified grounds.
