NYS Good Cause Evictions Property Owners and Managers take heed! There is a new important development in New York’s Landlord tenant laws, regarding market rate units in New York City, and potentially, other villages, towns, or cities state-wide. The “Good Cause” Evictions Law (“GCL”) was enacted on April 20, 2024 and is effective immediately.  Now, Landlords are more limited in seeking eviction tenants from residential units. There are also caps on rent increases, and required lease renewals. As an offset in Landlord’s favor- there will be consideration of certain operating expenses, i.e. property tax increases and cost of major repairs. GCL is expansive and applies to “all housing accommodations,” however there are several critical exemptions. Most notably small landlords, who own 10 units or less within NYS and Owner-occupied buildings that contain 10 units or less. Others include: Units already subject to rent regulation pursuant to local, state, or federal law, rule, or regulation;  Units which are required to be affordable for certain income levels pursuant to statute, regulations, restrictive declarations, or regulatory agreements with a local, state, or federal government entity;  Units on or within a building that is owned as a condominium or cooperative, or on or within a building that is subject to an offering plan submitted to the office of the attorney general; and  Buildings for which a Temporary Certificate of Occupancy or Permanent Certificate of Occupancy was issued after January 1, 2009, for a period of thirty years following the issuance of the certificate.    In addition, the requirements of GCL do not apply to sublets, where occupancy is incident to employment, to seasonal use units, units within hospitals, manufactured homes, hotel rooms or other transient uses, dormitories, or units within religious facilities or institutions. It is expected that GCL will dramatically alter the rental housing landscape in New York City, and possibly, the state, as other villages, towns, or cities state-wide opt-in.  GCL’s impact is broad and significant, so property owners and management are well advised to seek counsel. New York State is serious about environmental justice, climate change and improving air quality in disadvantaged communities. So much that NYS Department of Environmental Conservation decided to add a layer of EJ considerations to virtually ALL of its environmental permitting programs. Last week, DEC issued a final version of policy DEP-24-1 titled “Permitting and Disadvantaged Communities under the Climate Leadership and Community Protection Act”…and it’s a doozie! The policy will be relied on by Department staff “when reviewing permit applications associated with sources and activities, in or likely to affect a disadvantaged community, that result in greenhouse gas (GHG), or co-pollutant emissions.” The policy applies to almost all “major permit” applications including those for air emission permits, hazardous waste management and solid wastes to name a few. It also applies to permits issued under the Uniform Procedures Act for energy generating facilities. Permit applicants with facilities in State-designated Disadvantaged Communities will now be required to submit a preliminary screen to determine if the proposed action is likely to impact disadvantaged communities. If so, applicants will then be required to conduct a “disproportionate burden analysis” and propose design considerations to lower GHG or co-pollutant emissions. Oh…and the public gets a chance to opine and comment on the disproportionate burden analysis as well as the underlying application materials. I’m working on a comprehensive regulatory alert for this but I wanted to preview this now because this is so important. Things are changing rapidly and #EJ is here to stay in New York. NYS Housing Deal Package enacts Good Cause Eviction Law and Amends IAI Rent Increases   Good Cause Eviction Law: On April 20, 2024, the Good Cause Eviction (“GCE”) Law was enacted. While much of the new law takes effect immediately, the notice requirements, as well as the changes in rent demands and pleading requirements for summary proceedings, take effect 120-days later, on August 18, 2024.    GCE limits renewal increases to the lower of (i) 5% plus the percentage change in the Consumer Price Index (“CPI”) or (ii) 10%; and limits the grounds pursuant to which an owner may refuse to renew a lease. In the context of a renewal, an increase on a renewal of more than the lesser of 10% or 5% + CPI are presumptively unreasonable, but such presumption is rebuttable. Owners of unregulated apartments must show “good cause” where a lease is not renewed. A waiver by a tenant of any rights under GCE Law is void as contrary to public policy. Individual Apartment Improvement Rent Increases: The Rent Stabilization Law, as previously amended by the HSTPA and Clean Up Bill, has been amended to provide: - A permanent rent increase equal to 1/168th of the new cap of $30k, which equals $178.57 for buildings with 35 units or less; and, 1/180th for buildings with more than 35 units, which equals $166.67. - A permanent rent increase after a 25-year period of continuous occupancy OR if the unit was registered as vacant in 2022, 2023 and 2024 equal to 1/144th of the new cap of $50k, which equals $347.22 for buildings with 35 units or less; and 1/156th for buildings with more than 35 units, which equals $320.51.
