If Sabrina Willmer's news story depicts the usual interchange between prominent businesses and organizations victimized by cyberattacks and the US Federal and State regulatory agencies attempting to enforce the 2022 American Cybersecurity Act, then I think it is safe to say cyberattack victims like MGM Resorts International will make substantially more effort to protect themselves from reputation risk than they will to their effort to comply with requests from these regulators. What is the big deal? This defensive behavior also undermines the timeliness of public notification of malicious compromise of customer data on the part of these same businesses. Without timely notification, customers seldom have a chance to put their own defenses in motion - the "train has left the station". All the customers may be able to do is pick up the pieces. How might these opposing risks be mitigated? Who should be responsible for the fix? To quote Peter Drucker, "Culture eats strategy for breakfast".
