The National Coalition on Housing Justice (NCHJ) has issued a statement on the USICH Encampment Guidance. Overall, the statement both acknowledges the affirming strategies outlined by USICH (US Interagency Council on Homelessness) to address encampments as well as those that can be interpreted by localities to continue and pursue harm and criminalization against an already-marginalized community (including youth). We are deeply saddened by the latter, but understand that this means that we simply have a great deal of worthwhile work ahead of us as those who work to end and prevent homelessness. Chevron is dead. Since 1984, courts have deferred to a federal agency's interpretation of statutes within its purview. Known as "Chevron deference" this doctrine is now overruled by the Loper decision announced today. In the 40 years since Chevron, one could argue that Executive Branch agencies ran amok with rulemaking (a quasi-legislative function) and statutory interpretation (a quasi-judicial function). It will be interesting to see how much litigation Loper will spawn challenging such agency actions. One issue that comes to mind is the "Waters of the U.S." regulations. Loper will likely lead to more specific acts of Congress to ensure that the lawmaking function stays in the Legislative Branch and the judicial interpretation thereof remains with the Judicial Branch.

This week, the Fifth Circuit Court of Appeal ruled that the Federal Communications Commission's funding method for the Universal Service Fund is unconstitutional. We’ve all probably seen that line on our #cellphone bills for a Federal Universal Service Charge. So, what is the #UniversalServiceFund? It is a program that provides funding to #schools and #libraries for broadband internet and to #hospitals and #clinics for #telemedicine, along with #telephone services for people living in rural communities. The importance of the Universal Service Fund cannot be understated. During the height of the COVID-19 pandemic lockdown, telemedicine was a lifeline for every sick person stuck at home needing to see a doctor. For the millions of Americans who don’t have access to high-speed Internet, schools and public libraries are their sole gateways. This decision is almost certainly going to be appealed to the #SupremeCourt, but this is something that we all have a stake in.

States have seen a 23 percent decrease in state-level reincarceration rates since 2008, due in large part to the programs and support funded by the Second Chance Act. However, states are still projected to spend $8 billion on reincarceration costs for people released from prison in 2022. For states to continue to reduce recidivism, they must show that #ReentryMatters by scaling effective policies and reentry models that create meaningful opportunities for people returning to their communities. We are disappointed in the recent Fifth Circuit Court ruling that Congress unconstitutionally delegated power to the Federal Communications Commission to establish the LifeLine program. This decision threatens phone and internet connectivity for over 7.5 million low-income Americans and thousands of schools. LifeLine is a crucial program that helps close the #digitaldivide that disproportionately impacts communities of color and low-income communities. For these communities, digital access is more than just the ability to get online–it is the ability to access jobs, education, and opportunity. Closing this divide is critical for a just economy. This misguided ruling further erodes the power of regulators and Congress to act on behalf of the public interest. Just months after the shutdown of the Affordable Connectivity Program (#ACP), we now face another blow to the social safety net programs that protect our most vulnerable populations. We need regulators and decision-makers to stand up for #LifeLine and ensure that all communities have the connectivity they need to thrive. The NCUA is also seeking input from stakeholders on the content of the regulation, which has not been updated in 15 years, as well as feedback on the structure of the regulation due to the combination of #regulatory requirements and guidance.
