I honestly don't know if it is, as some have said, the "next asbestos" wave of litigation. What is certain is that PFAS #litigationrisks in the US are real, creating some ominous storm clouds. The so called "forever chemicals" in food packaging and consumer goods are regulated by close to a dozen US states. These state statutes and FDA regs are spawning dozens of new consumer class actions against sellers and manufacturers of food, food packaging, cosmetics and other household and personal care products. I'll be discussing these topics with by my colleagues, Michael Droke and Nathan Webster, on Thursday including assessing the current #litigationrisks along with practical ideas on what companies can do to weather the storm. Let's get rid of the carbon capture tax credit . . . This is what Bernie Sanders and Ilhan Omar have put forth in proposed legislation (S. 4406) called the "End Polluter Welfare Act of 2024. Supposedly, the goal of this legislation to stop favorable treatment for the fossil fuel industry. If this became law, many favorable tax code provisions would be terminated for fossil fuels because "[W]orking families should not be forced to pad the profits of an industry that is destroying our planet." I really wish the renewable and the fossil fuel industries would work together. There are working families in both!! So much more could be accomplished with collaboration!
