Unified Patent Court tosses Lenovo’s SEP injunction bids against Ericsson: undue delay, “clear-cut case” — and it has to do with LatAm PIs Motorola Mobility (a Lenovo Company) filed its UPC complaints over two standard-essential patents against Ericsson in late January. Months later they wanted to seek injunctions, telling a contorted story of how they first wanted to put Ericsson on notice through the complaints, though at that stage they were already seeking a UK SEP injunction anyway. The truth is that Lenovo held back with a view to its pursuit of a U.S. antisuit injunction and help from a UK judge with respect to Ericsson's then- and presumably still-ongoing enforcement of Brazilian and Colombian injunctions. The UPC's Munich Local Division (Presiding Judge Dr. Matthias Zigann, Judge-rapporteur Tobias Pichlmaier, Judge Pierluigi Perrotti) denied the two parallel motions as untimely. There was no justification for the delay, and requiring Ericsson at this stage of proceeding to build a FRAND defense would obviously make a major impact on Ericsson's defensive efforts. Tomorrow the United States Court of Appeals for the Federal Circuit will hear Lenovo's appeal of the denial of a U.S. antisuit injunction against Ericsson. In other news from this cross-jurisdictional dispute, the England & Wales High Court will resolve a question of contract law concerning an old Motorola Mobility license agreement ahead of the actual trial, but that doesn't mean Lenovo will win (and even if it did, it would still need a new license from Ericsson for plenty of reasons). On June 12, 2024, the House IP Subcommittee held a crucial hearing on third-party litigation funding (#TPLF) and its impact on U.S. national security. Rep. Deborah Ross highlighted the root issue: the unfair Patent Trial and Appeal Board (#PTAB). The PTAB invalidates 84% of patents it reviews, driving contingent fee attorneys away and increasing reliance on TPLF. Without TPLF, small inventors face insurmountable barriers, further risking U.S. innovation and security as China advances in critical technologies. Acts like the bipartisan Balancing Incentive Act (#BIA) and the Restoring America’s Leadership in Innovation Act (#RALIA)are essential to truly protect U.S. inventors and innovation. New Ruling on Punitive Damages and Attorney Fees in California Invasion of Privacy Act (CIPA) Case As Thompson Hine has previously reported, the recent surge of privacy claims under the California Invasion of Privacy Act (CIPA) related to using website cookies, pixels, and web beacons continues to impact a several sectors. It has been especially harmful to small businesses. On July 15, Judge Rolf Treu ruled on a preliminary motion in a CIPA lawsuit and concluded that the plaintiff could potentially recover punitive damages and attorney fees. Although this case does not address the merits of whether website tracking technologies are considered pen registers or trap and trace devices under CIPA, plaintiffs may rely on it to demand larger awards and settlements in their CIPA actions. Businesses that deploy these types of online tracking technologies should immediately reassess the legal terms governing the use of their websites and whether they contain favorable dispute resolution provisions, such as remedies available for claims arising from a consumer’s use of the website. An interesting case to watch. It all started in 2020 when Ikorongo Technology LLC sued Bumble Trading LLC for infringing two reissue patents. When Judge Alan Albright ruled in favor of Bumble, it was because he felt Ikorongo failed the "original patent" requirement.
