FRAND Terms: Evaluating Reasonableness Prior to International Trade Commission Remedial Orders
The Paul J. Luckern Summer Associate Edition of the 337 Reporter
Scholarly article arguing that the ITC should evaluate FRAND terms based upon their reasonableness prior to granting exclusion orders. The article further argued that Standard-Essential Patents (SEPs) should not be used for economic leverage with competitors, and should always be licensed using Fair, Reasonable, and Non-Discriminatory (FRAND) methods.
