The new NBA media rights deal, starting in 2025-26, will feature ESPN/ABC, NBC, and Amazon as primary broadcasters, shifting the focus from local networks to streaming platforms. This raises concerns among team owners like the Knicks' James Dolan about the potential obsolescence of local networks and the associated loss of local sponsorship revenue, a crucial source of basketball-related income. The shift could erode this reliable income, potentially lowering the salary cap and affecting player compensation tied to league revenue. If the league unilaterally prioritizes streaming over local broadcasts, it might set a contentious precedent by bypassing the collective bargaining process. This could lead to disputes over the management of the league’s intellectual property and revenue distribution. My colleagues and I at Bathaee Dunne LLP are pleased to have survived a second motion to dismiss in our antitrust lawsuit against Disney concerning the streaming live pay television market—the market in which YouTube TV and Disney’s own Hulu + Live TV compete (and now dominate). This is a hard-fought case that involves structural competitive problems—Disney owns and controls a leading consumer-facing competitor (Hulu + Live TV) as well as the market’s most expensive content input (ESPN)—and a host of other interesting antitrust issues, including a web of most-favored nation clauses (MFNs) and technological and contractual network effects. Yesterday’s order was the culmination of another grueling round of briefing and argument initiated by Disney’s attorneys at Cravath, and we are pleased to continue moving forward with Sherman Act Section 1 and state law antitrust claims, including under California’s Cartwright Act. Major new music copyright case to follow: Many (and I mean many) record labels sued Verizon alleging that it failed to do anything about rampant copyright infringement being done on its network. Peer to peer file sharing a la Napster. The 34 plaintiffs allege that they sent over 340,000 infringement notices to Verizon since 2020, which were allegedly ignored. Or, as the Complaint puts it: "While Verizon is famous for its 'Can you hear me now?' advertising campaign, it has intentionally chosen not to listen to complaints from copyright owners." I was surprised that P2P file sharing of music (allegedly) remains so rampant in the streaming age, when it's easy and relatively cheap to get your music from Spotify etc. Less surprised that Verizon rather than individual users is the target of an infringement suit. Excited to see where this goes and if the vicarious liability theories stick. Discovery should be interesting. https://lnkd.in/eDDFJ_7Y

Congress is serious about getting clarity on consumer, privacy, and possible collusion questions. Yes, Congress can take on media issues for other purposes, but these questions were asked in industry articles when the JV app was first discussed and then announced. Hoe constituents have access to sports, at what cost and perceived obstacles, is something politicians will always look at and I have to think that the experienced folks putting Venu together anticipated and are ready for these questions: if not, then the way ahead for Venu seems more than a bit uncertain. https://lnkd.in/efceE_TE

So how strong is the MLC’s case against Spotify? Will the MLC, working on behalf of songwriters and publishers, be able to win back the income lost to Spotify’s change? Based on MBW’s analysis of the case, we think the MLC has a solid chance of winning… in the short run. In the longer run, there may be little that the organization can do to prevent Spotify from switching a good chunk of its customer base over to a bundled offering.
